Buyer Claiming Non-Delivery

Sold an item on ebay, a psp game, sent item recorded delivery on 8th September 2006. I was quite shocked to see item delivered next day.

Today the buyer has sent me a message
hi mate, can i have the tracking number for the item as i havent recieved it as of yet. many thanks

Royal Mail Website states
Your item with reference DH026956646GB was delivered from our LUTON Delivery Office on 09/09/06 . Thank you for using this service

Now I have emailed him the tracking number so he can see its been signed for, is there anything I can do. Seems he's just trying it on, if he negs me can I leave a neg and put the tracking details in the feedback.

Surely, as he paid with paypal he won't win a chargeback as I have a Reciept for Recorded Delivery and Proof on there site its been signed for.

Any advice appreciated.

    The scanned copy of the signature on delivery should be on the RM website too, you could email them a copy of that as well to show you mean business! He would be very silly to neg you over a confirmed recorded delivery, but eBay is full of idiots!

    (edited-just noted you posted the Rec.Del.no and the proof isnt available online so you would need to call RM to get it.)

    [FONT=Verdana, Arial, Helvetica, sans-serif]It doesnt matter what you state on the listing, if an item is not received by the buyer it is the senders responsibility to resolve the issue, special, recorded or otherwise. A Paypal claim can be made by the buyer for non receipt and if you cannot provide an online trackable proof of delivery then they will find in the buyers favour despite your terms and conditions. Also, the 28 days you quote for RM to resolve lost items isnt relevant. They are currently taking around 8 weeks on average due to now having to write to the buyer to get confirmation of non receipt so you probably wouldnt have a reply from RM by 28 days anyway. Even if you did, its irrelevant if you cant provde receipt then the seller is still liable.

  • Normally I would say the buyer is trying it on however recently I was waiting for a parcel. The RM Website said delivered and signed for, however I had not received it, nor a neigbour etc.


    Ended up being at my local PO, was saying signed for by mistake, as when they tried delivery, they markwed it as delivered instead of back at PO.

    Just thought this may help. It seems silly that he would try to con you when he has all th evidence against him, so maybe he is genuine.
