would it be worth contacting the legal protection dept of your insurance policy? I f the other party is not admitting liability surely this will effect your no claims bonus for next year.

Not sure if they're not admitting liability or whether they're insurance company are just being slow and useless with things?

Maybe its time to stop being nice and tell him I've got witnesses to say his daughter lost control of the car because she was on her mobile at the time !!! (she begged wife not to tell him this).[/QUOTE]

My god I would have had the police out no questions if someone had piled into me while on their mobile!

I also think the OP has "missed the boat" with this now.

I doubt very much that the OP can now declare that the third party was also on the phone after several months of saying nothing.

It would look manufactured and as if you were almost desperately trying to come up with reasons for the blame to be with third party.

You also say your car was empty and the third party hit the rear.....if that's the case, surely there is no way for the third party to deny liability?
Can liability be denied and trasnferred to someone else in a car accident when they weren't even in their car????

Keen photographer with sales in the UK and abroad.
Willing to offer advice on camera equipment and photography if i can!

Exactly. I dont see how they can deny liability if there was no-one in our car.

I think its just a case of their insurance company dragging their feet over payment....
  • Update

Had another letter. Apparently, 3rd party insurers still aint admitted liabilty (doesnt say they've denied it).

My insurers are starting court proceedings now. Wonder if its time to start rounding up my witnesses?

Worth contacting the other person myself to see whats going on?

Definitely not - you could prejudice your position - leave it all to your insurers.

Starting proceedings is often just a tactic to concentrate the other side's mind on getting to a conclusion, and only a small minority of cases "started" ever end up in court.

Do not contact! It could well make things worse, they could then say you have been harrassing them should it go to court.

As you didnt see any mobile phone thats up to the witnesses and any cctv!
