Deposit Protection

My old landlord is taking my partner to court (funny hes not taking me as I was the lead tenant but hey ho) for unpaid utilities bills. He was having a disagreement regarding with the provider and we where unable to pay it. we have proof of all this from the provider. Hes saying hes never had our contact details so his first and only step was to use my partners dads address to take us to court :/ We have emails from us to him with our details on so we're not really concerned about that.

That bits not really my question but I think a bit of back ground helps.

ANYWAY, we our counter claiming as he did not protect our deposit. We where there and asking about it for 11 months and he said it was protected. We started getting balifs to our door after him so I decided to search deeper into the deposit thingy and he didnt protect it. Basically he protected our deposit 5 days after we sent him an email saying we where leaving,

It has been 13 months since we lived in that property so I'm wondering if anyone has had a similar experience and what the outcome was. I've taken legal advice regarding the claim but am still nervus as I dont want a ccj or anything.

Any help and advice would result in my eternal love- and lets face it, who doesnt want someone loving them forever... actually, maybe ppl dont want strange internet ladies loving them? :/

  • I dont think we'll be entitled to this 3x deposit thing my solicitor is talking about but I'm hoping that the money we will eventually owe (the issue hasnt been resolved with the provider) will be canceled out by the money he should give us for not protecting our deposit- what do you think?

    I don't understand why your landlord is taking you to court for unpaid utility bills. These should be in your and your partner's names so are nothing to do with the landlord, surely?

    Courts don't appear to be imposing penalties for registering deposits late so I don't think you've got much recourse there.

    As you vacated the property over a year ago what happened to your deposit, was it returned?
  • acording to the deposit company its still in there which is weird.

    He was disputing the fact that in his contract/mortgage thing it stated that switch2 was his utility provider. Because he refused to sign a contract with them we couldnt get it put in our names. I worked close with switch2 to try and get it resolved but to this day hes still not signed the correct documents
