I'm not an expert, but two of them worked for a FTSE 500 company, so I would expect everything has been done legally.

I don't see how it can be illegal. If you are running your own business, minimum wage doesn't come into it.

And the size and status of the company means what? If big or important employers adhered to the law, then I would be bankrupt. It may be done, but it isn't easy and it is more often done wrongly.

Sorry yes. I misread this. I didnt realise that the OPs employer is trying to make him self employed.

No actually - you didn't misread it. The OP at no point mentioned redundancy or self-employment. The poster you responded to was speculating and making up scenarios based on that speculation. There is no indication anywhere in the OP that the employer intended to make them self-employed - just that they intended to stop their salary and pay commission only. This is not the same thing as being self-employed - commission only employment does exist and, as you correctly pointed out, if it is employment then the NMW applies. Since the OP hasn't clarified (and perhaps doesn't know the answer) then either position may be the employers intention.

The employer wanted to keep me as an employee, so the NMW would apply in this situation. I did not sign and rejected the new contract which was offered, and nothing more has been said, so I assume the old contract is still applicable.
