Salary Sacrifice and lieu notice

I currently subscribe to my employers nursery voucher scheme through salary sacrifice.

A few months ago, I was put "at risk" and given a redundancy package illustration.

One of the items in the list was "lieu notice payment" which was a number of weeks of my post sacrificed salary to make up working a notice.

No mention of nursery vouchers or anything.

So my question is - can they do that - take the nursery voucher amount off your salary to work out your lieu notice amount - and not give you nursery vouchers or anything?

No - this is probably an error. Any lieu notice should be at the full amount of salary, and no vouchers.

I also think it is an error - but I have talked to my employer and they have said that - no it is not an error.

I dont really see what I can do about it.

OK. Well you will have to raise a grievance poiting out that your salary is XXX (the full amount), and that refusing to provide the full salary or the agreed salary plus childcare vouchers is an unlawful deduction of wages. If they still refuse you will have to take it to tribunal.
