Should I Start A Chargeback?

I purchased an item on BIN on the 12th Aug £9.95 with free postage.
I left it until the 24th Aug before contacting the seller (due to it being free postage i didnt think i could really argue it any sooner) to say i hadnt recieved the item and he replied straight away saying that he checked and it had definatly been sent out but would send out a replacement that day but please not to mention it in feedback if i decided to leave any.
On the 6th Sept i emailed him again as i had still not recieved the item again he replied straight away saying 'they have definatly been sent out please give it 2 more days. Im at a loss now to what else to do'.
Still not having recieved the item on the 10th Sept i emailed him again this time i have recieved no response at all.
Im now debating whether to start a chargeback.

Any advice?

  • as he asked you on the 6th to wait 2 more days, and it is now the 11th, I think you have been more than patient and would start a chargeback straight away - he can't say you've not tried to negotiate with him, but by not replying to your last email, I would take that as evidence enough to proceed - have you checked his activity over the last week? has he been buying/selling/leaving fb? whats his fb like? has it altered over the last couple of weeks? good luck and hope you either get your money or your item.

    he is still selling (though not buying im guessing he keeps this account for selling only) he has been recieving and leaving feedback also. Feedback hasnt changed at all throughout the time he has been selling he is a powerseller and with the type of items that he sells its the sort of thing that will work for some and not for others, and i would say 98% of the negs that he has are 'ok didnt work for me though' type thing i saw a few on there for non delivery but replacment sent but out of the several thousand of feedback he has it was a very small percentage that had the problem. So i thought i would be ok............

    I would at first send an email saying that you have waited long enough and now want your money refund immediately or will have to take the matter further .I would set a time for the refund and then start a chargeback, as most good sellers will refund at this stage .If by the time you set ,I usually give by 8pm,etc there has been no refund I would then initate a chargeback.
    The reason for the email first rather then the chargeback is -
    1 - for politeness incase the sellers is genuine & gives them the chance to sort it out correctly.
    2 - because you are only alloweed 3 chargebacks a year
    3- a refund through a buyers willingness is a lot faster then one through a chargeback ( which can take a month )

    You have waited a month! Start the chargeback, then you can 'communicate' with the seller all you like. He's only trying to make you wait long enough for it to be too late for a chargeback. Genuine reason for a powerseller to expect a buyer to wait a month for two phantom deliveries??

    Start the chargeback, don't warn him and don't give him any deadlines, enough is enough.

    hope you dont mind me posting here, didn't want to clog the boards with another thread about the same thing :o

    i have a very similar situation, purchased an item on BIN 18th Aug, not free p&p tho, i paid straightaway and expected item to be posted within a week or so. Nothing arrived and no contact from seller.

    I decided to email seller and ask if item had been despatched, seller said it had. Still nothing arrived. No further contact from seller other than to ask me to add feedback when item arrived.

    I emailed again on the 8th Sept saying item still had not arrived :confused: seller told me item had been despatched that day :confused: fair enough, seller has thousands of feedback (mostly positive) so i guess it's easy to mistake one buyer from another now and again and assumed he'd made a mistake first time he said item had been despatched.

    Item still hasn't arrived but if it was sent on the 8th it's not really a long time and wasn't thinking anything sus.

    I emailed seller yesterday to keep him updated and to ask for tracking number to check parcels whereabouts since it was sent by special delivery.
    No reply, I emailed again this morning, no reply.

    After checking feedback more thoroughly it would appear that others have had little in replys from seller, although he does ask that you contact him during office hours. (i have on both occassions)

    Now i'm getting a little jittery about it, although not many days have passed since the 8th if indeed it was actually sent then, i'm concerned that i've had no response to my emails. I always reply to mine the same day :confused:

    any advice on what to do for the best would be appreciated

    rushnowt, sounds like the first may have been lost in the post. Second sounds like it was not sent via special delivery, as that is a 24 hour thing. Although it has been over the weekend. Second class would arrive by tomorrow...
    Give him to the end of the week and then start a chargeback. The seller should be more talkative/apologetic when things go wrong. But these people are busy...

    rushnowt, personally I would start a chargeback. You've waited almost a month so far and the seller has obviously been misleading you about when the item was posted and what service was used.

    If you are worried about the chargeback maybe wait for tomorrow's post then if it hasn't arrived put the chargeback in then.

    For me if I hadn't got my goods or a jolly good reason why not within 2 weeks then I would start a chargeback then, I certainly wouldn't wait near on a month.

    There is no way that my address is wrong it is correct both on ebay and paypal im starting to wonder if he has actually sent them at all surely both couldnt have gone missing?
