Help with my rights - replacement item.

I bought an American style fridge freezer in Currys on 12th July. Following 3 cancelled deliveries, it was finally delivered on Monday.
Plugged it in - doesn't work.
I know I am entitled to a refund or a replacement, but it was bought on a gift card, so a refund is no use to me. The model we had is the last of its type. What can I legally demand when it comes to a replacement? Equivalent specification or equivalent price?

    FWIW, as I really like it, I told Curry's I didn't mind a repair. They phone me yesterday to tell me to go into store to select a replacement. The one we have was reduced, and the nearest equivalents are much dearer.
  • I think (i hope someone can confirm?) that they would have to give you one of equal or greater spec not price, after all it isnt your fault it doesnt work or that they have no more in stock.

    Did you leave it to settle for however long before plugging it in and turning it on?

    Cant remember the exact time but i'm sure i was told to do that when i purchased mine. To give time for everything to settle.

    Hopefully you won't need to 'demand' (;)) anything! Just smile sweetly and choose the replacement you want (regardless of whether it costs more). Who knows what's going to happen, you might be surprised.

    No, if they so wished they could force a refund back onto the Giftcard if this is the cheaper option for them compared to refund/replacement

  • Oh yes, but i shouldnt think they would have to force you into switiching it for another fridge of a lesser speck if you didnt want to do so.

    Unfortunately you cant force a replacement, you could force a refund (by rejecting it as its within a reasonable time) but thats it really.
    Back by no demand whatsoever.

    Yes, but they would only upspec it at their disgression as well, it has to be a mutual agreement between the two parties to go either way of the item in terms of spec
