    The OP states that his wife cannot walk far has lots of pain and has 2 operations already etc etc

    A little more than a bad foot.. with the pain and unable to walk I would think this is not a "trifling matter" and if the neighbours have very significant problems then they have no worries about claiming since would be justified in doing so (sigh)

    Then they wont mind the neighbours making up their own mind as to how disabling a bad foot is will they?
    You are just illustrating the point that no onlooker can decide how disabled someone else is [sigh]

    The people you see getting in and out of mobility cars are probably those like my husband who is the named driver as I can't drive, not necessarily the disabled person. That's why they appear to have nothing wrong with them.

    The neighbours can have any opinion they wish but the important people are the decision makers and if nothing to worry about then anyone who claims DLA at the higher rate for mobility will continue to receive claim

    However you and I both know that many people claim when they shouldn't do.... so if the OP feels his neighbours are claiming fraudulently then he should report them and leave it to the decision makers to decide whether the claim is genuine or fraudulent. Correct no onlooker can decide and they don't they merely have an opinion and if the onlooker sees with his own eyes people claiming for motability cars and yet appear to be in abuse of the scheme they he can report them - the fraud investigator will visit and observe and then obtain evidence if it appears in breach of the rules of the scheme :)

    It is not an issue I know nothing about. I know of at least 4 people who are neighbours all who have DLA and have minute things wrong with them. They openly admit they do not deserve it. Then the genuine cases such as wife have an extremely difficuly job being accepted after working all her life. I do object to people getting what they deserve but it's these people who feign injury or illness then openly laugh about it. And yes I have reported the cases many times and nothing ever gets done.

    Yes, I agree with you, but it does get on my nerves when people who have been refused automatically start deciding that they are worse off than their neighbours, it comes with the territory when you have children with learning difficulties that are not physically disabled and like to keep yourself to yourself so not in the habit of discussing the situation with neighbours.
    Maybe these neighbours are swinging the lead but it has nothing to do with the OP's refusal.
    Of course the other side of the coin is people stopped conning the system then the rest of us would not be under suspicion in the first place [another sigh]

    Well if they are actually telling you nothing is wrong with them and are laughing about it then that it is an entirely different matter, but I'm puzzled as to why people who are clever enough to work the system are so stupid as to tell everyone they have!

    But what is "minute"?

    And do you think people will really openly admit "I need someone to give me a bath"?

    I dont understand why people are attacking the OP, he is perfectly entitled to his opinion on his neighbours DLA claims especially if said neighbours openly admit they are not really entitled to DLA. And anyone who thinks all DLA claims are genuine are delusional, some people just know how to work the current system.

    The main part of the OPs original post was asking for help for his wifes application for DLA yet no one seems bothered enough to help, only criticise him for having an opinion!

    I would definitely appeal this decision as if people with illnesses such as depression qualify for HRM then your wife with actual mobility problems most certainly should.

    Alot of applications that are initially rejected are awarded something on appeal.

  • My Dla was turned down in March for my son, and I am currently awaiting the tribunal date.
    So far, I requested the reconsideration.
    Then I went to the council (welfare rights), and they got me to sign something to say they'd represent the claim (Appeal).
    Now I am just awaiting a tribunal date, (approx sept/oct), about a year after the claim was received, but tribunals told me there were 13,500 people to be heard before me.
