My FOS update/Hamilton

Was meant to post up last week but did not get round to it.
Letter dated 2 July 2010


Dear Mr & Mrs XXXXX

Your complaint against Hamilton Insurance Company Limited

I am writing to update you on the progress we have made on the complaint about Hamilton Insurance Company Limited.

As explained in our previous correspondence, we are investigating the possibility of raising your concerns with the underwriter of your policy, i.e. the insurance company who actually provided the cover under the policy. The underwriter has not accepted responsibility for the sale of the policy and we are giving this issue further consideration.
Consequently, I am unable at this point to indicate the likely outcome or provide a timescale. I will keep you updated on a regular basis with any progress we make.

In the meantime, it would be very helpful if you could let us know of any recent changes in your personal circumstances that you may not have told us about already - for example if:

. you are now experiencing exceptional financial hardship because of your circumstances connected to your complaint;

. you are sufffering serious ill-health, which makes it extremely important to you that this complaint is resolved quickly.

. legal action is being threatened to this case; or
. you have had an offer of settlement since we last wrote, and you have accepted this offer to settle your complaint, (or are considering accepting it).

If you no longer wish to pursue your complaint through the Financial Ombudsman service, you are free to take your dispute to court instead. But we cannot give you legal advice about any court requirements or resctrictions (for example, on time limits) and you may wish to check these.

    Ive written to Hamilton last week Di re PPI as both central and Endeavour are telling me No! If they come back with a 'its not for us to deal with' answer, shall I call FOS?

    Di when I was going for my "rebate" complaint I know that when talking to the manager who was in the special team dealing with "insurance" type complaints because of unregulated brokers he said that as yet FOS were in talks with insurers as to responsibility regarding sales and that they had no idea when this (or if this) would take effect. I know that he said to me that as mine was about a rebate and not a misselling then the insurer had to take responsibility but regarding the misselling he said that as yet insurers were not taking the responsibility. I personally don't understand the issues and laws and he said it was very complicated too and that the FOS solicitors and the insurer solicitors were both in talks. I would just hang on in there as you really have nothing to lose unless you want to take it court. Anyone that has a rebate complaint can get it sorted pretty quickly but you cannot make the insurer repsonsible for the sale IF you go for unfair rebate. One or the other and not all rebates are actually unfair.

    Will do! do I explain ive written to all involved and still no joy? What will FOS do, will they write to Hamilton?

    Hi

    Yes, tell them you have already been the other avenues and hear that you can pursue through the underwriter/insurer.

    I would get the go ahead from the FOS first, and you can if you want to ask if they would write on your behalf, or you can do this yourself like you did with the others, if this fails and they say no, the FOS will investigate this for you and write to them anyway.;)
