    Shouldn't HMRC have informed BIL that NI was not being paid? that there was a shortfall and what that shortfall was?
    I also believe it is accountants fault but BIL is in no position to take action against accountants and I am looking to try and help him get some money in while he recovers from heart op. Would HMRC look sympathetically at his case i.e. is it worth contacting them to ask for a review.

    Its not up to HMRC to tell people to pay their NIC's on time. They can, and do, advise of shortfalls but its usually well after they are late.

    Your BIL hired the accountant - if the person he hired wasnt up to the job then it is ultimately his fault for hiring that person.

    It is worth contacting them but you have already said that HMRC said they havent marked them late?

    Accountants aren't interested in Class 2 NIC, only Class 4 as part on the tax assessment.

    As I, and others have said, late paid conts are automatically treated as such, and JCP must use the date they are paid to calculate if benefit can/cannot be paid. JCP have no choice in the matter, but as i said HMRC can be pursueded otherwise.
