Pot Holes

Hi,

I've just been denied a claim by the council. What can I do now?

Thanks

Either instruct a solicitor if you really think you've got a case or forget about it.

Appeal and instruct a solicitor if you believe you have a strong case!

Around here the council say that you can only claim for damage if you notify them about the pothole BEFORE you hit it!!

IIRC, the general rule is that you have to be able to demonstrate that the council knew about the pothole and neglected to remedy the issue within "reasonable time".

I know when I've reported potholes through Fillthathole, Leeds City Council have been out with a temporary bodge-fix within three days or so.

If you could explain the circumstances it would help everyone understand if you have much of a case or not.

Request to appeal their decision on grounds the grounds you feel you have.

I would try and obtain some form of evidence, eg a garage estimate or similar to support your claim against them

    Good luck :D
