Yellow card from Allied International Credit- HELP!!!

Firstly, thank you for taking the time to read this.

Well, I after I graduated from uni, I took out a Graduate loan with HSBC. I found it very difficult to get a job, and as a result I ended up defaulting on my payments. Stupidly, I failed to try and make contact with them when I started to get to get on my feet with a job and stuff, but neither did they attempt to contact me.

I arrived home yesterday, and there was a yellow card waiting for me dated 20th July 2010 from Allied International Credit, asking for full payment of £3676.66.

I called them immediately, and the lady that I spoke to was nice, but not at all helpful. She told me that I had to make payment of 65% of the amount (which is £2390), and I had 48 hours to make a decision and call back, otherwise they will take it further. I told her that there is no way I afford this (my monthly income is around £1100, with monthly outgoings totalling £985), and asked what the next course of action would entail. She told me that she is "unable to speculate" and she "wouldn't like to say".

So now I am at a complete loss. I know that this is my own fault, but I am unable to come up with that kind of money. I live with my partner, who is also unable to afford to lend me the money, an dthe last thing I want is baliffs arriving at the door to take his stuff!

I do not know what I can do now, and I am scared as to what is going to happen now.

Any advice or words of wisdom would be VERY much appreciated.

    Ignore these clowns, their threats mean nothing.
    They have no legal power to any money off you whatsoever - only a county court does.
    Stop phoning them and refuse to answer security questions if they phone you.
    Its not for them to dictate what you must pay & when - you are the boss of them, not the other way round.
    They will accept what you offer in a like it or lump it sort of way.
    It will cost them money to take you to a court, thats why they just rely on threats & intimidation.
    No bailiffs can turn up - only court appointed & that would be a last resort after all other avenues had failed.
    Report these rogues to the OFT & trading standards if you wish...

    Thanks, that helps re your legal situaTION.

    First things first, never ring a DCA, as they lie and bully you.

    Second thing, check your credit redcords and see if this debt has already been defaulted.

    Do you have any joint accounts with your partner?

    Regarding bailiffs it is incredibly rare for this to happen and if it did

    1. They can only take your things.
    2. They cannot take normal household items,.
    3. They can only take them if you let them in the house/flat.

    Apart from cars, they can get nothing if you know what you are doing, and they can't get the car if you know what you are doing.

    So calm down.

    Do a Statement of Affairs on here, so we can see what your situation is. Then you can write to this lot and tell them if you can afford to pay them more than a nominal amount each month (£1).

    Only county court bailiffs have the authority to turn up & take things - anyone else can simply be told to go away and the police called if they refused.

    Seconding what's already been said, do what RAS said, it was excellent advice.

    Also more on why you never speak to them on the phone...

    They can't do much to you in all honesty, and they certainly wont file any court papers for weeks yet, if they even do (usually they don't, they just SAY they're about to any minute). Not having any real power is why they lie, intimidate, harrass and frighten people. Their favourite way to deliver this is by telephone because you almost certainly can't prove they did. You wouldn't wanna know how evil they escalate to being over the phone when they think it'll work (people have been driven off the edge by it). Even if they play nicely on the telephone (and what you're getting currently IS nicely) they will accidentally-on-pupose not write down anything you said that they don't like or worse still outright invent what you said. You really wouldn't believe any company could get away with these sorts of practices would you- until they do it to you.
    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared

    How do I check my credit records? And what is a Statement of Affairs? Like a incomings and outgoings lists?

    Sorry, I am completely clueless as I have never been in anything remotely like this situtaion before

    Your credit file is held by the three credit reference agencies (CRA's).

    Equifax http://www.equifax.co.uk/
    Experian http://www.experian.co.uk/
    Call Credit http://www.callcredit.co.uk/

    The law says you can have a printed copy of it for £2 (your statutory report), so to get that you click on the statutory report bit on the CRA's website, all three websites are fairly straightforward. Or even better all three are currently letting people view thier report online free for a month, just remember to write down the date you have to cancel to avoid paying though.

    Actually speaking of remembering dates, there's a free text message service to help you, it's called the Tart Alert http://www.moneysavingexpert.com/cards/credit-card-tart#alert

    A statement of affairs is a sheet with your income, expenditure, capital and debts and it can be used as an official document too in the right format. If you can do one and post it in this thread we can have a look for you and make suggestions. It hasn't got naything identifying on it. Also save a copy in Word.     EDIT: Forgot to say you need to see all three of your credit reports because they can be different, so a loan might show on one file only or all of them, you never know.

    I am going to have a crack at the Statement of Affairs tonight and post it either later this evening or tomorrow. If you could look back on it then, I would be so very grateful to you.

    I will also look into getting my credit report, and detail back here when I get the information.
