Just wonder how th OR looks on depression mental health problems in BR.
Some of the reason for me getting in to the mess im in is due to depression and berevements etc. I take responsibility for it all but how sympathetic are they?

Hello HUAFU, Which debt charity is helping you? I know that CAB can access you medical paper's if needed for your case. I have known OR's to be very sympathic to similiar cases as yourself so no worrying you will be fine lol x
Best wishes

Ive had advice from cccs, they advised about the BR but didnt really take much info on how it all came about.
I have had treatment for depression which came about by several berevements of close family members in a fairly short space of time.
I dont blame anyone or anything else for my situation but depression has played a part and im hoping that br will in a way be a new start.0 -
on the bankruptcy forms there is a space to explain your reasons for bankruptcy, you could include some information here, backed up by a doctors letter if required.
i'm sorry to hear of your losses x0 -
Ive filled in the reasons and have mentioned it all but just wonder how much notice they take of mental health issues.
Do they just go on the cold and hard facts or do they also take personal problems in to account.0 -
I didn't think they looked that deep into it? The OR's must have hundreds of new cases all the time - surely they are just looking to see if a) there is any fraud involved and b) whether someone was completely irresponsible?
It's well known that debt and mental health problems are linked. Surely what matters is that you have recognised the problems and got help?

Well I know that our OR read the reasons for our BR and we discussed it, he then summed it up into a couple of concise sentences and asked if I agreed with it.
So I am guessing that they would take into account all your circumstances hardup, put it down it can't hurt anyway.0 -
My wife's mental health (inc depression) as well as psysical health was a major factor for my BR. The OR listened and accepted what I said concerning it but I'm not sure to what extent it was relevant as far as he was concerned. He certainly agreed that her condition meant that public transport use was not an option so I'd say that they do take it into account, how much is hard to say.“Procrastination is my middle name....well it would be if I could be ar**d to contact Deed Poll."0

The OR takes mental health problems as seriously as they take physical health problems. If you have been receiving treatment and it is a factor in the bankruptcy, then a letter from your doctor would go long way to help explain your situationHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.0 -
Thanks, I probably can get a letter if they think its needed.0

Hi HardUp,
I have an IVA and suffer from Depression. My GP and hospital consultant provided evidence to the IVA company and they did take it into consideration.
Depression is an illness, just as cancer, asthma, diabetes are. It is, without proper treatment, usually a terminal illness and is now (thankfully) treated with respect and taken seriously.:T
Everyone's situation is different - but if you have received (or are still receiving) treatment for Depression, regardless of whether it was brought on by bereavement, trauma, or is part of your bodily genetic make-up, it's important to know that your doctor is taking it seriously.
Despite what some may say (along the lines of "Depression is just an excuse to skive off work", it's "just because someone's too pathetic to cope", people with Depression "are just self-pitying whingers",etc.), Doctors generally do NOT diagnose Depression or prescribe treatments for it just "to get rid of whining patients". It is a real illness, which can have a profound effect on one's ability to cope and function normally.
Because your doctor has taken this seriously, the OR should take it seriously as well. I would certainly advise putting it on your form, with supporting medical evidence if you have it.
You are being very, very brave, HardUp, in dealing with your difficulties, despite all that you have faced in recent months. You are going to be OK - and, one day, I hope you can feel strength and courage from having dealt with your debts and your Depression. That day might be a long time in the future - but, believe me, it WILL come.
Good luck to you. Please keep us updated with your progress - and feel free to PM me if you ever need a bit of moral support or just to sound-off.
Keep going. You'll get there.
