    Hi Paul

Sorry to hear of the difficulties you have been having. Have you heard of "Contact a Family" If not it may be worth your while contacting them or checking out their website. (Sorry not allowed to post links as a new user) I have called on their help in the past - admittedly not about DLA - but their advice and support has always been useful. In certain areas of the country they have family workers who will visit you/attend meetings with you etc.

    Good luck with your tribunal.

if her care needs involve someone needing to watch over her all day in the event of such a life-threatning crisis - you should get mid rate care dla. if someone needs to watch over her day and all night, you should get high rate care.

Depending on the age of the child, it could be argued that children of the same age need watching over during the day too.

I think that this is the problem. It doesn't matter that you're choosing to keep your child at home because of her disability because lots of children don't go to nursery for various reasons.

Your daughter needs to have more care needs than a child her age and, as she is very young, it can be argued that all parents of children her age need to keep constant watch over their children.

I think you should appeal it but you may find that her needs aren't considered to be higher than other children her age, in which case you can simply re-apply after the appeal.
