He could alsways make the suggestion that he has spoken to the HP company and they aren't very pleased and will be reclaiming the car if it isn't handed back to the person named on the HP agreement and that she will incur fees for this?
Just depends on whether she's bothered about stuff like that I suppose.
OP if you do get the car back can you afford it?
no i am afraid she would not be bothered about anything like that and yes i can afford the car. i would pay off the outstanding then just sell the car on.0 -
OP how long is left on the agreement, how many more payments have you got to make?
If there aren't many then I would be inclined to say bear the loss and put it down to experience I'm afraid.
The problem is that your ex-GF is going to see the car as belonging to her because she is making payments to you and not an actual finance house.
Does she actually realise that it doesn't belong to either of you?
Just to edit, she might not be able to get the finance put into her name, the finance co might decline her (not that I know anything about her financial situation, just why didn't she get her own car if she's OK for credit?)
You are correct they would decline her and her parents that is why it was in my name in the first place, unfortunately she has just quit her job as well, i have not got a clue why. Although she is still intending on buying a new car in the next couple of weeks. She has made all the payments to my accout to date but now she has no job she will not be able to afford them and if she is buying a new car i am a bit worried she might try sell the car i have the finance on. No i do not have a spare key.0 -
The problem will come if (when?) she tries to part exchange the financed car for her new one! I'm not sure if the garage will do an HPI check, I guess they would? If they ask her she might just say it's not under finance. AFAIK if that happens you would be liable to pay off the debt with nothing to show for it.Trev. Having an out-of-money experience!

Has more than 1/2 been paid off the agreement and are you able to do a Voluntary Termination?
Any reputable garage would do proper checks anyway.
It might be a blessing in disguise if she did do a p/x because you could have more luck dealing with a garage - as long as you know which garage of course but since garages usually put their own advertising on the cars they sell you could do a drive by to check this info out should the time come.
Just had a thought that she might try to sell it privately?

I think he needs to get peace of mind about this because really unless she's told him directly that she wants another car then he's heard it 2nd hand.
OP needs to be saying look ex-GF there are x amount of months left to pay on the finance at £x amount per month can you let me know what your intentions are please?
If you no longer wish to pay for the car then I will need it returning immediately. If on the other hand you would like to carry on paying the monthly amount until the final payment has been made then this is fine and obviously the car will become your sole property one the finance has been settled.

Thanks for the advice. I have had an update, she has contacted me from her new number and asked how much the final settlement figure is. so maybe she isn't so evil after all.
I will find that out what her intentions are then report back.
