Hello,
I foolishly decided it would be a good idea to get a car on finance for my now ex-girlfriend. The log book and car is all in her name however the finance is in mine and the direct debit comes out of my account every month. At the moment she is paying each month by standing order direct into my account, but i have recently found out she is intending on buying a new car and i think she is going to cancel the standing order. We are not on good terms and shes has changed her number etc. What can i do to either get the car back in my name or to pass the finance over to her?
Will she be able to sell the car behind my back without me finding out?

    Just double checking- is the finance secured on the car?
    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared

    Was it a bank, loan then bought for cash.

    the finance was arranged through the second hand car dealership.

    If the finance is in your name ,you are paying for the car , then technically you are the owner, you can be the keeper of a car without owning it, send her a letter asking her to take on the finance , if she agrees , get it in writing , if she will not tell her to return the car to you or you will take her to court as you had a verball contract with her , you would pay as long as you were a couple, worth a try.

    I dont think the police could help she has not stolen the car from you , but if you could somehow get the car from her ,then you would i think be within your rights to keep it. as you are paying for it.

    Important point to look at. But it all depends upon the finance. If it is HP - as it is here, the above is likely to be correct. If it was a loan, then there is no end of a fight to be had over ownership - ex could claim it was a gift.

    We are in agreement ,that was my reason for asking if it was a loan.

    So ideally I need to just face up to it go knock the door and ask for the car back? or ask her for the rest of the money to cover the finance.
