Faulty item, paid on CC... claiming on section 75, but need advice on what I can clai

I've purchased a faulty oven. I've had it exchanged by the manfuacturer 4 times.
The last time it was replaced, it was replaced for a cheaper model.

I have spent a fortune on electrician (checking electrics and disconnecting / re-fitting) and this appliance does not have all the features and functions of the one I originally purchased...and then there is the price difference.

What are the credit card co liable for? Consequential losses? the original oven? the cost difference of the two appliances...etc

Thanks in advance

GW

You have to deal with the retailer first - only when you reach deadlock with them will your credit card company become involved.
  • Oh done that!
He was very abusive etc. So I think we've reached that stage!

I just want to get my facts right for the letter to CC co as they have already said there is nothing they can do..... but no reason.

So my letter will be outlining to them that they are liable under S75, and (if applicable) I would like my consequential losses covered to. But I don't know if I am entitled to claim for the full original oven, or the difference.

(Before anyone jumps on me, I am not trying to get a freebie out of this, just trying to follow guidelines)

    Thanks

Not sure what you hope to gain by consequential losses - you will get the difference between the original cooker and the one delivered provided you have accepted the current one and are happy with it.

Or return the oven you have if it doesn't meet your specifications and then claim for the whole amunt so you can buy again.

The cc company are equally liable.
