By the way was the CCA legal???????????????
I cannot enlarge it, so cannot tell. It is very unusual for a Cap one CCa to be legally compliant.
Did you not check this and explain in your submission to the judege what the prescribed terms are and how this CCa failed to meet them?If you've have not made a mistake, you've made nothing0 -
Well, I had the same problem with them, Lowell, I offered about 15 quid a month, they didn't want to accept that, they said is 43 quid, or we make you bankrupt, so no choice for me at the time, so paid 43 a month, with a lot of problems, I'm in the process to ask them for a SAR, once I get that back I will decide how I do approach the case.
Hi Fribourg, I'm surprised they didn't accept. When I did a DMP for oh, I wrote to all the creditors (about 6 of them) and offered according to how much owed e.g one was offered £2 for £300 approx up to £15 for £4000. I sent a SOA to all of them, all but 2 accepted and they went for a CCJ, I sent a SOA to the court and the Judge agreed we were broke so we only paid £1 on those:) The CSA were taking a huge chunk out of oh's wages, so they probably saw it was pointless trying to get blood out of a stone!;)0 -
Hi Fribourg, I'm surprised they didn't accept.
Well, they were really a pain, and the threat of a bankrupcy was enough, being a single dad with two little boys, well not really little, 8 and 12 right now, was enough to pay them what tehy asked for, but as I said before, once I have my SAR back from them, will see what I can do, one thing is for sure, once the debt gets to less than 700 quid, then, they will hear from me, I mean, I will go for it, unless I can do it before hand, because I know right now, that that debt is unenforceble, so just need the proof, and should be on the way, I did offer to pay back, ok, very little, but they didn't want to know, so I will get them, I'm sure about that, seems like a war declaration to me, and I will go for it.0 -
