SNAD dispute - what if seller doesnt collect?

Hi all

I returned a item through parcelforce on friday and I entered the tracking number today on the SNAD dispute.

From what I read on the internet I think parcelforce attempt delivery once. Before I entered the tracking number the seller sent me a email saying they had no intention of answering the door when parcelforce knocked on or collecting the parcel.

So I was wondering if they just ignore the door and the parcel gets re delivered to me will I win my SNAD claim?

Its cost me 12 pound to send it back so I dont want lose out on more money :(

EDIT: Also I didnt buy the items off ebay, I bought them off a forum. Sorry one last question. After I entered the tracking number paypal are now awaiting the sellers response - I was wondering what this was for?

    Does the tracking show an attempt was made at delivery?

    If so phone paypal and tell them that and also tell them that you can supply emails from the seller saying he will refuse the return. Paypal have found for the buyer in cases where selelr refuses to accept a return.

    Its doesnt say anything yet it says on route to hub. However with the seller emailing me saying she had no intention of answering the door I am now worried I am going be even more out of pocket:(

    If it says delivery attempted but not refused would I lose my claim?

    I would wait until the tracking updates & then phone Paypal. As soolin said, they do tend to refund when the seller doesnt accept the return.
    Your better off phoning Paypal rather then emailing as they seem to respond better on the phone.

    13.6 How is the Claim resolved?

    Once a Dispute has been escalated to a Claim, PayPal will make a final decision in favour of the buyer or the seller. You may be asked to provide receipts, third party evaluations, police reports, or any other information or documents reasonably required by PayPal to investigate the Claim. PayPal retains full discretion to make a final decision in favour of the buyer or the seller based on any criteria PayPal deems appropriate. In the event that PayPal makes a final decision in favour of the buyer or seller, each party must comply with PayPal’s decision. PayPal may require the buyer to post an item back to the seller that the buyer claims is Significantly Not as Described (at the buyer’s expense), and PayPal may require a seller to accept the item back and refund the buyer the full purchase price plus original postage costs. If a seller refuses to accept the item, PayPal may award the Claim in favour of the buyer, provided the buyer has provided satisfactory evidence to PayPal that the item was sent to the seller. In the event a seller loses a Claim, the seller will not receive a refund on his or her PayPal or eBay fees associated with the transaction. If you lose a Significantly Not as Described Claim because the item you sold is counterfeit, you will be required to provide a full refund to the buyer and you will not receive the item back (it may be destroyed).

    It is clear to me. You send it back, they refuse delivery. You may need to remind Paypal, but it is their Buyer Protection Policy.

    I had this problem, with the seller taking over 2 weeks to pick up their RM special delivery. I just phoned Ebay as soon as the tracking showed as attempted, and was given full refund 20 mins later!
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
