overpayment

Hi,

After a recent re-calculation I am owed over £200 back from the CSA.

I had a call from them and they asked do I want the money back and if so we will collect it from the PWC.

The PWC is on benefits so how would they collect it back?

I'm in a bit of a dilema now as I don't really want to take £200+ pounds back as it seems a bit mean. Maybe I'm being a bit soft!

Mike

Are you still paying maintenance? Can they not take it off future payments?

    Nope,

I have a £0.00 assesment and I have no arrears.

I just feel mean taking money back, even though she is my ex.

It was only 1 month overpayment.

They should refund you anyway and they can worry about how they recover it from the ex.

Just seemed odd they would ask me if I wanted my money back.

Maybe thought you would be kind and say no its ok she can keep it and treat the children?

They can get it back from her if she is on benefits, it will be at £5 per week so will take 40 weeks for you to get your money back

40 weeks for me to get my money back or 40 weeks for the CSA to get the money back?

You will get it as a one off payment.

I actualyl seriously doubt whether they will recover the money from her - they very rarely do from PWC as thee is the potential fear that the children could suffer as a result (by not getting food for example - not in a physical sense).

It's your money and you have a right to get it back so ask them for it.

    Thanks all.

Funny why they ask. Do you think its to see if you feel guilty and hope you let the PWC keep the money to save them doing the re-claiming paperwork?
  • the csa care if a child suffers OMG what crap what about when they leave NRP not enough money to pay the morgage and bills and the child that lives with them suffers or even when they take tax credits into consideration...............mmmmmm do the csa really carer or is it cause the RP is thier client.

    *sigh*

I was giving the OP the factual information.

I may not always agree with any info I give but if someone asks a question then, if I know the answer, I give it.
