Missold Gym Contract to a Student over the summer.

Hi there.

Just got an email through from my brother who has taken out a Gym contract at Fitness First whilst he has been back at home (i.e with the Parents!) over university.

He made it clear when he was joining the gym that the contract was for himself as a student who was due back at University in September. He was told he'd need a month to cancel the contract and that it would be just for the summer.

Apart from it's not.... Apparently he is tied into a 12 month contract... (grrrrrr)

Can anyone recommend what the next step will be?:o

I've said to fire off a letter to the Head Office and the local branch complaining about this....

If he has signed a contract for 12 months, will he be tied into it? Can anyone shed any light? Any assistance to a cash strapped student would be very helpful...

    Yes he would be tied to the 12 month contract. As I understand it, you can only give a month's notice to terminate at the end of that first 12 month period.

    I would write to head office and/or the branch informing them that the membership was missold and that it had been made clear at the time what was required.

    HOWEVER, he has signed the agreement and thus agreed to the terms and conditions. He should have read these before signing and he only has himself to blame if he did not. Therefore legally they have the upper hand but appealing to their sense of fair play and to avoid loss of reputation, they might be willing to do something to help.

  • I've found fitness first to be, how can i put it nicely, not very "student friendly". Me and my friend went for one of them free trial days and the staff asked us where we from etc and then were extremely rude to us. Didn't stay there very long.

    Sorry thats a bit OT, but it adds to how un-"student-friendly" they are.
