    I would go and get anything thats mine from the house. I would especially get personal things like photos but I would also get anything I paid for which I have a receipt for. So if you paid for anything in the house yourself and can prove it you are entitled to it. If you think there might be trouble when you go in you can ask for a police escort.

    If the Order was against your Ex, then I beleive that they can only take his property. If you can prove ownersship of any of the goods in the property, then they can not normally be seized.
    I am sure, also, if you asked the bailiffs, they would allow you to collect YOUR possessions, probably in return for key.

  • As it would appear that this case related directly to the house the possession order will only apply to the property its self, and the fixtures and fittings, all personal property remains under lawful title to the O.P and her Ex unless a separate order has been levied on the personal possessions in relation to other debts.

    You should UNDER NO CIRCUMSTANCES re-enter the property using the key to the changed locks, you will be committing a number of offences if you do.

    The house is no longer yours as it would appear that a possession order has been lawfully executed, and that the bailiffs have seized the house on behalf of the owners

    The only course of action you have open to you at present is to inform the owner of the property ( Building society / bank) of the situation and ask to reclaim you personal possessions. They can not lawfully refuse you this, however they will obviously be less then impressed that a previous entry has been forced and the locks changed.

    The balliffs now have no further involvement, their obligations have been fulfilled and they will of handed possestion to the owners.

  • omg !!!! what offences, i cant speak to the bank as im not on the mortgage, they wont speak to me, data protection,
    i really need my memories back, kids toys etc, the estate agents have said that if i have a key it will take a while to change the locks, i havnt been told anything, except get it out, none of this is my fault, what is the worst they can do, ask me to leave, ???? surely no policeman is gonna arrest a women and 5 of her girl mates packing baby clthes and photos ? i am so desperate...

  • mickey i would just do it, you and your kids will lose that part of there lives if you dont go and recover your possesions, there is laws you will be breaking but surely you have lived there before so people know you, so whos going to report you the neighbours :rolleyes: if i was you i would take the chance....

    My friend got evicted last year...they agreed a date with her when she could have 7 hours....to pack a whole house needless to say we didn't get it all done and had to leave loads as they wouldn't give us any more time.

    I'd just do it if you have a key... as least then you wont loose any of the kids stuff.
