Will not refund a faulty item

I bought a motherboard from Maplin Electronics in store last September (09) and instantly it would not work. So i swapped it for another one in store the same day.

Last month the usb's stopped working. My external hard drive and my mouse stopped working o this motherboard but they worked on other devices.

So I put windows back on my system thinking it was issues with windows but still nothing.

So I went and took it back to the store and had it sent off as they need to test it. I have been told it works fine when they tested it so they are refusing to refund it and are sending it back to me.

In the mean time I purchased another motherboard as I needed to get online so now i am £130 out of pocket.

What are my rights here?

I am saying its faulty and they are not so I am out of £130

    Am not 100% sure on this but am sure someone will correct me if Im wrong but if you get it tested yourself by an independant person and a fault is found you should recieve a refund for the replacement and the testing but if no fault you get nothing..... Like I say though not 100% sure on that :)

    I'm also not 100% sure but I would think after almost a year you wouldn't get a full refund anyway. Maplins would be well within their rights to get the board repaired.
    I think you jumped the gun a little when you bought the new board

    Not just a fault, the fault has to be inherent and not through misuse or wear n tear.

    Basically within the first 6 months they need to prove the fault isnt inherent. After that, you (the consumer) need to prove the fault WAS inherent - which as you said, is done via a independent report being commisioned which (if found the fault to be inherent) you would be entitled to a refund for.

    They're not liable for the costs of the replacement though. They can repair/replace/refund (and it can be a partial refund to take into consideration use you have had of the item) and although you can request one or the other, the final decision mostly lies with the retailer who will usually opt for the most cost effective method (usually repairing).

    EDIT: also sometimes its worth speaking to the manufacturer if you get nowhere with the retailer. Sometimes they'll play nicer than retailers (and vice versa!)

    I will be getting it tested first. If it works then I will sell it on. If it dont. Then it goes back to Maplin
