Tesco Diets - changing information- kind advice please on next steps?

I am also having a battle with Tesco Diets and was told couldn't cancel within the usual DSR 7 days as could have had instant access - actually I couldn't as set the start date for a week's time so could access nothing.
My issue is that the weight it told me I needed to get down to was not the same before and after I had paid. This means I have no faith in their service. The second weight was too low for me.
I have sent email proof but I'm dealing with lots of different staff it seems, and have not had a response.
The one I dealt with most has told me what I'm saying couldn't and doesn't happen (GGGRRR) but has not commented on my emailed evidence. She has given me the email address for her supervisor I believe - who hasn't replied.
My next step I believe is a solicitor's letter - for the sake of £30 it hardly seems worth it but I don't have £30 to waste and the high handed and dismissive approach of that particular member of staff has really got my back up. It's the principle of course too.
Would love some help on next steps - have found email address for head honcho, too soon to use?
Please only friendly help - no 'you should have done this' etc etc, I can't rewrite history!
Thanks

So this is some sort of dieting service with meals? Like those ads you see on tv but tesco? And you cant get out until you reach x weight?
Im having trouble why a target weight would put you off, surely if your happy with the first quoted target you should just reach that and cancel?
Need more background info otherwise its just a shot in the dark....
Edit: Seems clear cut to me... unless you post more detail about any misleading statements......

Looks like you can cancel but they won't give you a refund for what you already paid.

By registering as a member you agree that we will make the members' services on the Tesco Diets Site available to you immediately. The provision of these services means that you will not be entitled to cancel your membership pursuant to the Consumer Protection (Distance Selling) Regulations 2000, i.e. you will not have the usual cooling-off period.
No cancellation option is available during the first day of membership. However, outside of this you are free to set your account to cancel at any time during your membership. All cancellation options are available in the 'My Account' section of your personal online account. Alternatively, we will accept requests to cancel via email. Cancellation will take affect from the next membership renewal date and you will not be entitled to a refund for any monthly membership fee already paid.
I guess you could argue, as you said, they have been inconsistent in the target they set but having had battles with tesco in the past (not diets) they are notoriously bad at sorting this type of thing out and will not refund.
I'd stop trying diets..start eating better on your own and exercise...it works and doesn't cost you a lot. There is lots of free information on the net to help you plan healthy meals.....and it's far easier to stick to! I've tried them all, unsuccessfully, not I'm doing it on my own. I'm more motivated and the weight is coming off nice and steady.
Good luuck battling the tesco giant. And I wish you all the best on your weight loss journey.

Without Prejudice
firstly thank you Hudson - I did mention that you can choose to postpone the service to start later, in my case a few days later, in which case you can access nothing. So I had none of their information which kind of nullifies their nullification of the DSR I think!
The issue with the target weights is this:
One enters a number of different figures, height, age, current weight etc and then one is given information as to how much weight could/should be lost. As a once health editor I am more than aware of what is and isn't a healthy range. To be given a target weight and then five minutes later a different one - which I know to be unhealthy is not acceptable and I think potentially dangerous in the wrong hands.
The diets are then designed with these targets in mind. The more they tell you to lose, the longer you are on site and the more you pay.
Half Pint, thank you for your kind comments and advice. I only want to lose a few pounds and was curious because of my previous career. Had hoped it would all be easy and convenient!
You may both be interested to know that the Office of Fair Trading told me that, from what I have said, Tesco are not carrying out their side of the contract with reasonable care and skill and therefore are in breach of contract under the Supply of Goods and Service Act 1982.
I don't want to take this to court but so many consumers say that they have had similar experiences with Tesco acting, in their opinion unfairly, that I feel like taking a stand.
All I know is I will contact Mr Leahy and I won't shop there again until satisfied. If you've anything to add with this new, hopefully clearer!, information then would be grateful to hear it.
Thanks - oh and perhaps I should write here 'in my opinion' or 'without prejudice' (not sure if using this phrase correctly but just in case it's worth something here!) in fact I think I'll write that at the top!0 -
It is pretty silly writing without prejudice on here, it really doesn't mean anything.
Can you illustrate the difference in weights given?Gone ... or have I?0 -
Hi,
Not really much advice I can give you but I hope you get this sorted.
I have used tesco diets in the past and their site is rubbish.
Have a look at weight loss resources, it's a great site to get you started on healthy eating and then you can go it alone. It's got really good forums on fitness etc too. It's more expensive than tesco but you get what you pay for.0 -

thanks for the supportive messages and just to let you know that I went to the top with this and I got an apology and a refund - I referred to this link and site in my email. If anyone else ever comes a cropper in this way feel free to ask for further info to help with your own case.
And to DMG24 I see you think what I wrote is 'pretty silly' and don't see why I would write it. Ironically I don't see the point of your bothering to tell me that.0
