Car accident in friends car with permission - no DOC, who is liable for cost?

    I think that both people are responsible, and both should bear resonsibility for the costs.
    As the owner of the car your friend, sorry, your friend's friend, is responsible for only allowing people properly insured to drive it.
    As the driver of the car, you, sorry, your friend, are responsible for ensuring that everything is in place for you to be allowed to drive it legally. This means going to the lengths of checking insurance paperwork, MOT etc etc before you get behind the wheel. There are serious implications to simple paperwork offences with cars, as you, sorry, your friend, has already found out.

    IF you, sorry, they, can maintain a civil relationship, I'd suggest getting the problem sorted out between you both, and splitting the cost down the middle or by whatever you decide is appropriate. If things aren't civil, then I'd suggest a letter from a solicitor telling them to approach you through the small calims court if they feel that they are owed money.

    Of course, to me it sounds very much like the owner was drunk or in some other way not meant to drive, speared the car into a barrier, then swapped seats with the passenger before the police arrived without fully thinking through the consequences. The new 'driver' is therefore very hacked off that by trying to keep their friend out of trouble, they have been hit with 6 points and a fine. Just how I might see things on arriving at such a situation in a professional capacity......
