Here is the assumption from one motor Insurer which disproves your generalisation that Insurers do not differentiate between different convictions and / note this in their questions / assumptions.
"No driver to be covered by this insurance has had any criminal convictions or pending prosecutions relating to fraud, robbery, theft or handling stolen goods during the past five years"
I think you need to read my previous posts...I have made no assumption that insurers do not differentiate in fact it is completely the opposite.

Yes it may be relevant to the insurance company as some convictions will load premiums more than others...
My point is that the OP is not asking for a list of insurers that may take her 'risk' - she was asking if she needs to disclose the fact her son has "potentially" got a criminal charge pending, and seeing as the question asked will most likely be along the lines of "Do you or any member of your family have any criminal convictions or criminal convictions pending?" then the nature of the conviction is irrelevant when answering that question.
Anyhow...as I am fed up with saying he has no convictions or convictions pending as he has not been charged. At this stage he is simply helping police with their enquiries.....
I am not sure how else I can explain this - but I will try.
Until he has charges brought he has done nothing that needs to be disclosed. AS an example....If i went out today and was speeding down the motorway. I know I may have been caught by a speed camera/cop. I therfore know that I may be charged with a speeding offence. I therefore know that I may get a criminal conviction. Does this mean that I should inform my insurance company now? No of course it doesn't - I don't know if I have been caught, or if I was whether charges will be brought, or if I would be found guilty - at this stage there is nothing to disclose if the question..."Do you have any criminal convictions pending? is asked of me.0 -

The question that most insurance companies ask is ...Are there any criminal convictions or criminal convvictions pending?
They do not ask:
Are there any muder convictions pending?
Are there any traffic convictions pending?
Are there any child abuse convictions pending?
They just ask for convictions so you would have to disclose all and any that you have?
Your arguement about speeding on a motorway is a completely different scenario to someone who has actually been arrested and / or bailed.
If you read the OP's first post she is actively looking at finding an Insurer to cover her. If she advised us what the potential conviction is we might be able to direct her to Insurers that would not have a problem with it. Selden asked what type of potential conviction it is for exactly the same reason.0 -

Yes I am perfectly sure. I know what I typed andI even copied my previous post in for you...the one stating that some insurers will load premiums at different rates depending on the type of conviction...How on earth does that say that I have 'assumed' they do not differentiate between different types of convictions?
As for the post that you copied in to support your arguement. I am stating there that you can not chose which convictions you disclose and which you don't based on what you think the insurer will be interested in. If the question asks if you have ANY convictions then you must disclose them ALL.

Until charges are bought there are no convictions pending. As (another) example. There may be a fight outside a pub and 10 people get arrested as it is difficult to tell who is guilty and who is innocent in the furor. At this stage none of the 10 have a conviction or conviction pending (this is the stage that the OP's son is at). All 10 are helping police with their enquiries. Once investigations have taken place, 4 are charged. Those 4 now have convictions pending. The other 6 are as free as they were the day they walked into that pub!
But I only sold insurance for 5 years and am fully trained and qualified so what do I know.
I have PM'd my advice to the OP and will now leave the thread as

No disrespect but 5 years selling personal lines insurance is not much experience when it comes to insurance.
OP if you can tell us what the potential conviction we may be able to point you towards Insurers who it is not a problem with.0
