if it's not held in a scheme and your ll witholds your deposit you should be able to recover it via small claims court plus a fine of 3x the amount as your ll will have broken the law

if your deposit is held in a scheme then your ll would find it hard to deduct anything for damage if the property is in the same condition as it was when you moved in save fair wear and tear. make sure you keep a copy of the original inventory, ask to be present at the check out inventory and take lots and lots of photos of the property when you leave.

I checked post codes on those sites, but nothing registered. No answer to his phone, so have left a message.

For all I know, he may be fine about everything, we have not had any problems with him as a landlord, its just good to know we can actually move and should not technically lose our deposit for the notice.

    Thanks very much.

there is no way he can deduct YOUR deposit for notice reasons- you will be giving him more than you have to

despite being a tenant i tend to fall on the ll's side of an equation rightly or wrongly but if he has not protected your deposit he is just giving other lls a bad name ansd should be punished for breaking the law

    good luck x
