    On another note, my landlord have only recently december of last year, got a buy to let mortgage and they asked us to lie to the surveyor who came round saying that we were only staying there as a favour to them and not a tenant. They also asked us to lie to the housing benefit about how long we have lived here, any ideas why?

    He had a residential mortgage upto now and didn't want the mortgage company to find he had already let the property.

  • If you want your landlord to give you notice before he works on the garden then just ask! No point getting so upset.

    Unfortunately, his actions don't invalidate the notice to quit. Find a new house and start looking now!

    I'm afraid the landlord has to give you written notice as to when he is entering the property and you are within your rights to say the time is inconvenient. On the other hand you are entitled to change the locks and not give him a key so at least he can't enter the property.

    I would start looking for somewhere else to live now and also get onto the council straight away. If however you havn't found anywhere by the end of the notice stay where you are. If you leave of your own accord the council will see it as you making yourself homeless. He will have to take you to court to get you out and go by all the legally binding proceadures to do this. It will take a while to get to court and they will probably give you another 2 months to find somewhere to live. Then it will go to court again and you might get another 2 months or the courts will grant the landlord his property back. You still can't leave though until he gets the bailiffs in as again the council will see it as you making yourself intentionally homeless. The major downside to this is that you will end up having to pay court costs and might end up with a CCJ.

  • many thanks for the replies! I have spoken with the council and have an appointment to see them tommorrow, they have told me that his behaviour is unacceptable so hopefully something will be done about it.

    With regard to the inland revenue is there anyone I can tell about what he has done and would the be interested? he has been renting out the property for 3 years in total. Would him mortgage lender be annoyed that he was renting out without having a buy to let mortgage?

    Did you lie to HB and mortgage surveyors when he asked you to? If so any claim to the contrary now may well end up looking like you are the liars and this is sour grapes as he has served notice to quit. To strengthen any allegation you may make do you have proof of previous rent payments or a contract for the period he has asked you lie about?

    I would write to him and ask him to give you warning of when he would like to come round to carry out work, you can withold permission if you chose.

  • I went to the council today to discuss what has happened and they are going to write to my landlord for two reasons, one, he has actually filled in the eviction order incorrectly!!!!:T what an idiot, but on the plus side it means we will have to have a new one which will give us at least another week! two, to tell him that his behaviour is inappropriate and to cease otherwise the council will take it further.

    So a bit of a better day in my "soap opera!" and he has not come around at all today, bonus!
