convayencing

i am in an awkward situation, i am buying and selling a house. my solicitor has not sent me ANY paperwork in two months, she has stated, despite strong denials from them, that she has not recieved any paperwork or instructions from the vendors, now normally i would tend to believe her, except, in this time she asked for , and recieved, my wifes passport and driving licence(picture card) and returned them via royal mail RECORDED DELIVERY. this then went missing, for two months. as we are due to go on holiday in just over a month, we had to apply for new passport etc, we did this on wednesday, when we also sent a fax stating that i would be claiming FULL compensation for this. THREE hours later she informed us that the missing items had been returned, during all this the only statement she made was " we are not liable" it has now gotten so bad i cannot talk to her without feeling that a labotomy would improve her somewhat : ) now because of her we have to move within a week or lose our new home and the sale of our current house. can anyone give advice on what legal grounds i have for making a complaint against her .

    Wow. What a rant. Not sure what you wish to claim for. The passport going missing? The house? What?

    If the passport was sent back recorded delivery, what else could the solicitor do? Isn't your beef against Royal Mail?

    I'm also confused and can't work out what the issue is.

    The passport turned up back with solicitor within hours of you reporting it missing and stating you'll have to get a new one, so problem solved, no issue.

    I'm not sure how a temporarily missing passport is linked to losing a house sale??!?!?!

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    i think he's saying no paperwork has been processed and that normally he would believe her but because of the passport, he doesnt.

    However if my passport were sent back to me recorded delivery and it didnt arrive, i would be asking them for the tracking number................

  • sorry been offline for a while, the passport was missing for six weeks (approx) my beef is that we are due to go on holiday and had to replace the passport, i feel that as the solicitor had sent the item recorded delivery(max comp £41) the solicitor should have done more than just say " not liable" as the contract of delivery was between them and the post office.

    I would move this to the House Buying section, they can advise you on how to best deal with the conveyancing issues.

    Since the solicitor is claiming not to have received anything from the sellers solicitors ring the estate agents and get them on to it.

    If you are very unhappy with the solicitor and don't really trust her anymore ask her to prepare a bill to date since you are unhappy and wish to find another solicitor.

    This is about a passport going missing in the post not a conveyancing issue.
