Letting agy lost contract - claim ?

Hi All, hoping to pick your brains. Basically My mother rented a property via a agency with her partner, they split up & I moved in to help her cover the cost so I paid the rent from my account. We spoke to the agents & they advised they can add me on to the agreement no problem as I had previously rented from them before & advised they had agreement from the landlady. 2 yrs later I was moving out & buying a property, the Mortgage company applied to the agency to confirm I was a tenant & had been paying the rent without fail but the agency apparently had lost the tenancy agreement with me on it (they hadn't provided us with a copy) so refused to confirm I was a tenant & only stated I was paying the rent on my mothers behalf which wasd a lie. Now I lost the mortgage because of this & had to use a sub prime with an extra 2% per month plus an extra deposit. I'm wondering if I can I do anything about it, I was paying rent on a property they claim I was not a tenant in & will have nothing in writing to say I was paying the rent on my mothers behalf so could I try to get back either the rent paid or the extra I had to pay on my mortgage? Thanks !

    Why did you go with a sub prime lender rather than just pull out?

    Could you not have just used the council tax bill to show you were a resident in the house, and your bank statement to show you paid the rent?
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    "" (they hadn't provided us with a copy) ""-- you should have chased them at the time... it is up to tenants to keep their own documentation safe... you cannot blame others because you" forget" to get yourself a copy of your own agreement...

    You had 2 years in which to chase up a copy up the tenancy agreement. I am not sure why you think you should be able to get back the rent you paid?

    I agree with pinkshoes or were you not on the electoral register or registered for Council Tax?

    For future reference always do things in writing , & keep copies, so that you have a paper trail.

    Im confused. Surley the most important point is that you paid the rent for 2 years without fail? Does the fact that they wont confirm you live there not actually increase your chances of a mortgage i.e. not only are you paying your mothers rent you are paying to live somewhere else as well?

    Hi, I was on the electoral role but the mortgage company wanted confirmation that I was a tenant and even though I sent copies of my bank statments & of council tax bills with my name on them this wasn't enough as the letting agent where saying I wasn't a tenant. Unfortunately my mum thought she had recieved a copy of the updated agreement but when she checked she hadn't, obviously I know now I should have double checked. I needed to move out & buy, the mortgage adviser tried other companies but hit the same problem so had to go sub prime. Clutton, pinkshoes this is supposed to be a help & advise forum, how exactly are your comments either ?

    you lost the mortgage because YOU did not chase up your tenancy agreement and you are now trying to blame other people for your inefficiency... AND also trying to get money out of others....

    My advise is learn from this and learn how to organise your paperwork so you never get into this sort of muddle ever again.
