Paypal Dispute - To Cancel or Not?

I'll try to keep this short!

I ordered two books from US seller on July 31st which still haven't arrived. After many replies from the seller asking me to give it a few more days I started a Paypal dispute on 30 August. I really want the books as I'd promised my son and they're not available anywhere else for the same low price (I've bought from the seller before with no problems). They have other copies in stock and have now agreed to send replacements as long as I cancel the dispute first. I just thought that I'd check with everyone here that it's ok to do that, I get the feeling that they might be tricking me (paranoid maybe!?).

    Do not under any circumstances cancel the dispute, if you do and the second set of books do not arrive then you cannot reopen the dispute and your money will be lost.

    The easiest way of doing this would be for the seller to refund you in full, thus stopping the chargeback. Then for you to send a new payment for the second set of books which means the seller has no dispute hanging over him and you have a brand new transaction that will enable you to do another chargeback if the second set fails to arrive.

  • Tell them to send your original order, then you will cancel. You have paid for the goods so you should recieve the goods as you have not received them you are entitled to make a claim. If it was me, I would persue the claim, like you say they could be b**s**tt***, and if I am right you cannot put in a new disputewith this seller once you have clsed thisone (someone who knows the ins and outs will be along soon)

    stick to your guns and make sure that they send it, paypal will (i think from past experience) want to know that you have received the item and ask the seller to resend anyway and provide tracking details so you shouldn't let them off.

    Thanks for the advice. I've asked for a full refund and said that I will re-order.

    Thank goodness for this board otherwise I'd have been lost in ebay/paypal issues so many times!

    Just a thought, but how were the books posted? Surface mail takes up to 6 weeks, so they could be still en route.

    If they were sent by airmail then it's fair to assume they either didn't post them or they are lost n the post somewhere.

    So now what? That reply doesn't even make sense. I guess that I click this button "I would like to end communication and escalate this dispute to a claim with PayPal"?

    The books were sent by DHL btw.

    It’s in Americanish. Allow me to translate. :) “I’m sorry, but we don’t offer a refund, after we initially send the order out to you. We only offer replacement items. Thanks.” I guess you need to go back to your seller and explain why you won’t be cancelling your dispute. The only reason I can think why your seller won’t refund is if they believe you did get the initial pair sent to you. If they believe you didn’t get the initial pair, they refund you, and you then don’t repay, they can start a NPB strike against you, just as if you never paid in the first place.

    Escalate the claim...it doesn't matter what terms the seller has if he can't prove delivery then paypal will find in your favour.

    One word of warning though, if he is a casual seller (and it doesn't sound like he is in this case) then he might have insufficient funds in his paypal account. However if he has a continual turnover, or you have a credit card to fall back on you will be fine.

    The only other thing I am concerned about is that he is now warned that you are considering a claim and may well have pulled all his money in preparation.

    Thanks for all of the advice. I escalated it to a claim today.

    I'm so thankful for all of the advice on the occasions that I've had to ask for it here. Ebay would have me in such a muddle otherwise.
