Your best bet is still with Ebay i think. Given the age, i think it would improve your chances if you have to go to a small claims court but i also think you've damaged your chances at small claims by not giving the seller enough of a chance to remedy the situation before taking matters into your own hands. Small claims is relatively cheap though so its up to yourself whether its worth the risk or not.
he has just said no returns in about 6 emails it was bought has seen and it was working when sold. told him i had a report from goped and whats needs replacing costs etc to get it running has it should and all he said is well they would say that wouldnt they coz they want your money0 -

Yes but after the seller your first port of call should have been EBay. If Ebay required anything further (reports for example), they would have informed you of this.
I dont suppose you can see from his feedback whether he sells vehicles on a regular basis? If he does, it could signal he is a trader posing as a private seller.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
