Garage took to much deposit

We looked at a car in june at a local garage (with not the best reputation). The value of the car was around £10,000

After a test drive we decided that we liked the car and were told that we would need to pay a deposit of £100 to secure the car, we went home to talk about it and an hour later phoned the garage to say we wanted the car, we were told that the car would be ready in a few days.
A few days later we changed our minds and decided that a people carrier would be a better choice, .Later that day the garage phoned to say that the car was ready and we can pick it up,
after telling the salesman that we had changed our minds and would be happy to forget about the £100 deposit ,he told me that the car had already been registered in our name and taxed (which was a lie as we did`nt sign anything or ask for it to be registered, also not reg document arrived over 1 month later.

The problem is when i checked my bank statement £200 was taken instead of the agreed £100.

I spoke to the same salesman a few weeks ago and he said that they made a mistake and the money would be returned , suprise suprise it hasn`t , where do i stand can i speak to the trading standards etc .to try and get the £100 back?

    I would speak to the garage again, speak to the head / boss, and send a copy in writting recorded delivery first and see if that gets anywhere.

    It looks like they deliberately took £200, if you hadn't notice they would of got away with it. You best contact your bank asap and get it back, as I think there is something like a 45 days from transaction taken to get the bank to do a chargeback. This garage is rogue and you are probably best not to give any business to them.

    Called them again today and spoke to the same salesman and again he apologised and told me it would be sorted out today, so i`ll give them until next week and see what happens, both times they have admitted it was an error on there part .

    Congratulations.

    So many folks come on here after paying a deposit, making a verbal contract in my opinion, and then try to back out and want a solution to getting there money back :mad:

    As you realise £100 is a reasonable non refundable deposit. If you want to back out you pay that price. The overpayment needs sorting with the garage, but bear in mind the salesman could just have breached his "instructions" by taking a low deposit to clinch a sale, so was covering his tracks ;)

    Hats off for having the balls to say you made a mistake and have to pay for it. :T:T:T

    So i have now given them another week after being promised the money would be returned twice now and guess what ,still no money in my account!

    What should i do now? This salesman is really starting to annoy me by the way he totally admits to it over the phone and then nothing happens.

    Do a chargeback from the bank like I said, simple.
