Help, Unpaid Debt, letter from solicitors.

Not sure if this is the right forum but here goes.

Firstly I don't have any debt problems expect this one ;) .

Right I have just received a letter dated 10 August saying that I have not paid a bill for NTL (Which I think was not returning an NTL box - even though I have). It also says about how I have ignored all previous corrospondance etc etc.

So the letter goes on say pay all by 17th August (bit late but I have only just got the letter) or court proceedings shall begin.

So they want £395.90 + £159 in fees.


So thats the letter, and the situation is....

I moved house, and gave NTL a forwarding address and contact phone number. Phoned them up to cancel everything and return all their stuff. No problem all done.

So now I recieve this letter - almost 2 years after I moved. Which was addressed to my old address and returned to sender by the tennants. I guess the post office delivered it to me by getting my address from having post redirected for a month or two after I moved.

So thats that. What to do?

I would assume phone them but should I give them my address and phone number (which NTL already kind of have). etc etc.

  • sounds like a 'letter before action' and it will go to court.

    ring them offer a repayment plan and stick to it, only what you can afford! nothing else no matter what they tell you!

    show willing to pay it, and the ccj will not happen (hopefully)

    show interest in paying it back but dont go out of bugdet.

    Sorry I may not have made it entirely clear.

    The box was returned(I'm only assuming it is for this). As far as I'm aware I do not owe them anything.
  • if you are 100% sure you do not owe them, you have no worries what so ever!

    Its that simple, if it did go to Court I dont think it will stand!

    Make it clear to NTL you dont owe them a penny!

    Sounds like a NTL 'database error' in which like me British Gas has done me proud!!!

    Court, yeah I have told them see you there if you wish!!


    Database errors happen all the time, not saying your is but dont pay if you are 100% certian you dont owe the money!

    I'll phone up NTL tomorrow and have a go at them.
  • If it were me, I would prefer to do EVERYTHING in writing at this stage.

    If it will make you feel better to ring them, get the name of the person you speak to, and write notes of the conversation whilst it's fresh in your mind. :)

    This is just to protect you........... You can prove what you've written, but it's much more difficult to prove a phone convo :o

    Indeed... Writing to them is V important, write to them, recorded... I have complained many times to them and found their complaint procedure very good. They will respond and you will be able to sort this out. If you believe thay are also at error, tell them, strongly !! you may be surprised at the result.

    Dont worry too much about the letter being from a solicitor, they are probably inhouse anyway...

  • I've been through NTL hell as well when I moved house. I had no NTL in my new home and they were threatening to disconnect me !! Phone calls and emails got me nowhere but I had a list of when I'd phoned/emailed and the 'action' they'd promised. Forward a few months still letters threatening me. In the end I got the name of the chairman or someone on the board, (from their website) and wrote an epic letter praising them for their 'communication' and their customer service by attatching a list of every phone call and letter I had sent them in relation to the matter. I also asked them to reply to my correspondance.

    I then had the standard your bill has been settled no further action will be taken - but no word of sorry.

    If you know you have nothing outstanding - don't worry about it. Write a letter though don't phone.
  • When i moved house, i received a final demand letter from Scottish Power, for the sum of 12p! I rung them up and told them not to be so ridiculous! Have you contacted them??
    Debt at Highest, £18,000.00 :eek:

    Okay, I guess I will ring them up to find out what the debts for. Just to confirm it, then send them a nasty letter.
  • If you write to the solicitor and tell them that the debt is in dispute they are not allowed to attempt to collect it. If they do report them to the OFT under their debt collection guidance. If you google it you will find it
