Some advice needed please

hi guys well this week at my work has been a nightmare, the company i work for are in dept and have been taken over by the bank we have a company thats making offers to buy the company but nothings been confirmed yet, we have to go in tomorrow to have a big meeting and it will probaly be are last day, but i have a few questions, my boss told everyone that if we get made redundant that we could claim the redundancy off the goverment? and that if we have holiday left that we have not taken we could also claim that back to, and if we dont get paid tomorrow we will claim that back all from the goverment, i just want as much advice as i can. i have never been in this situation before.

    You will need a lot more clarity (which you may get tomorrow) about what will happen. It is entirely possible that if another company buys your employer out, that your jobs will be secured as part of that and you will be TUPE'd from one employer to the other. There is a government scheme that covers a capped amount of wages / redundancy - but it doesn't step in straight away and is a place of last resort. Wait and see what you are told will happen, then come back when you have some information to go on.

    yeah i know if we are bought out are jobs might be ok but i just wanted some advice soi could put it to them tomorrow. thanks for the quick reply.

    The administrators should come in and declare the company insolvent if they can not sell it. If it goes insolvent you will get a form (RP1) from the administrators to claim any outstanding wages, holiday etc. This money will come from the redundancy payments office.
    Note, these claims are limited to £380 per week.

    You should also get the union to look into compensation payments for not giving you a redundancy notice period. All firms should give notice of redundancy (it will take a tribunal to get the money).
    For between 20 to 99 redundancies - 30 days notice
    For 100 or more redundancies - 90 days notice.

    Even if they hadnt been given the right amount of notice, if the company is insolvent, I doubt that they would get compensation from the government scheme. Probably just the very basic owed.

    In any event, i hope the company can be sold and you all keep your jobs.

    we heard last night that the company has gone thats all i know we all have to go in at 9am today for a big meeting but not working. i will let you know more when i get back. thanks for all the advice.

    You can get compensation for the redundancy notice on an insolvent company, but it takes about a year and you would have to go to an employment tribunal.

    30 days at £380 per week = £2280 before tax if over 20 employees are involved.
    90 days at £380 per week = £6840 before tax if over 100 employees are involved.

    I did not think these minimum consultations applied to insolvency(nothing to consult) and that normal notice periods applied 1 week per year over 2 or contract if more.

    i have been hearing lots of different thing about claiming redundancy i thought as i have been there 8 years i would get 1 weeks wages for every year i was there. the bank who took over the company i work for gave us a form to claim back any holiday wages and redundancy owed to us all, i have filled it in and have to take it back to work in the morning for him to send it off.
