Faulty goods but paid with Credit Card??

I purchased a pair of Dior glasses from Wantglasses last September. Since then the crystals have fallen out. I spoke to an advisor there who after a few promises of call backs finally said my replacement glasses would arrive the next day. Still waiting!! Weeks have passed with no cantact, phone numbers don't work and no reply to emails. As i purchased tham on my credit card I contacted Halifax but have received a letter today saying they can't help. I thought they would be able to claim the refund for me, any advice???

    Halifax are fobbing you off, you are entitled to use Section 75 to hold Halifax repsonsible for your rights under the Sale of Goods act.

    But......
    As you would be seeking redress under Sale of Goods.
    1. Theoretically as 6 months has elapsed since purchase its upto you to prove that the glasses were flawed at the point of purchase rather than being damaged through usage.
    2. The manfacturer/Halifax can choose to repair/replace rather than refund.

    They are over six months old but I wouldn't say its mis use that has caused the crystals to fall out. They weren't faulty when purchased. Halifax has stated in their letter that as they were not faulty at point of purchase then it is up to me to find a resolution with the company.

    They may not have been obviously faulty at purchase, but there must have been some inherent flaw that has caused them to fail after such a short period of time.

    unfortunately you need an independent expert opinion though in order to enforce your rights on the Halifax. (as the 6 months from purchase has elapsed)
