    I understand your point.

    Firstly I am not overly concerned with being served a DN. I dont ever want credit again so not too concerned with my CR.

    I dont want a CCJ and face going to court.

    My question is would the court allow a CCJ if I have written proof an arrangement to pay was agreed by them to pay my arrears in 3 monthly installments along with the current repayments. And are the charges lawful for the letters they have been sending me chasing the payments AFTER the agreement was made?

    I dont see how they can agree an arrangement only to change their mind?

    mr.ton, you have a particular perspective which is fine for you. I would go so far as to say that so-called 'credit scores' which people pay good money for are effectively a waste of money. But the raw credit record does contain information which can limit your life choices in matters such as taking out a mortgage - and can force you to always live in rented accommodation or force other choices on you. If you are in a position where such things don't matter to you - eg if you are approaching retirement or retired, I can agree with some of what you say - but you do need to put a health warning on it, because many people here would till aspire to some of the choices which depend on their credit record.

    hi all,

    Bit of an update, after I sent my letter yesterday, I have now received an email from Creation apologising for their actions and have assured me the arrangement has been set up and all charges waived. RESULT!!

    Good result then, might be worth getting a copy of your credit report in a couple of months just to make sure they didnt enter a dn.

    However i'd say the default is defective whether sent first, second or whatever other random postage people are using so if they termintate the contract they will of done so unlawfully and you would only be liable for the arrears at the time of termination, but I gather this is a grey area.
    As for credit historys, i'd say its disgusting the way creditors use them as a weapon, I know they are to show how you handle your debts but they use them in such a way that your life is over without credit, when ofcourse its not, probably the absolute opposite if anything.
    From a personal view I found my first default liberating as 4 more followed and I regained control but thats my view as they have nothing left to throw at you other than(mainly empty) threats of court.
