default notice please help!!!!!

iam in arrears by £310.00

i have charges of £190.00 for sending letters.

i have received a default notice for £500.00.

if i pay the £310.00 before date of dn, can they still take me to court for the charges

I have an email from them confirming my arrears repayments from 2nd aug, but they are now completley ignoring the fact they ever sent this. thanks x

    Who is the company in question here?
    They can go stick their charges for the letters were the sun dont shine for starters :eek:
    Report them to the OFT,trading standards and any other authority you can think of as well.

    hi thx for replying its creation finance, i set up an agreement to catch up with the arrears back in june, first pmt being 2nd aug, and i have proof of the arrangement. but they are sending constant letters still charging me upto £100.00 a time, now have DN my mum can lend me the 300.00 but not 500.00, can they still get ccj for letter charges/

    £100.00 everytime they contact you? :eek:
    I love to see them try going to court for that one.
    Have you sent them a CCA request to see if they have the right to be obtaining any money off you in the 1st place?
    Do not be lending money off anyone to repay any debts.
    The most these robbing b*stards deserve is £1 per month.

    surely they cant take me to court for charges that i shouldnt have as i have proof of an arrangement to pay being accepted

    I very much doubt they will, however if so,you can argue to the court that the charges were illegal/unfair.
    Id love to see any court trying to justify that charges on that scale are justified.

    A default notice doesn't mean they are going to take you to court, so please stop worrying about that, they could go for a CCJ but for such a small amount it's unlikely.

    Are Creation a catalogue company? when did you take the account out?
    Unless I say otherwise 'you' means the general you not you specifically.

    its a personal loan, the 310.00 is arrears i owe then 5k in total

    While I can see where you are coming from, if the leese2504 is concerned about her credit record, you have given poor advice. Form previous posts I believe I would be correct in saying that you are not concerned about yours.

    leese, once you get a default notice, you do have a chance to pay within a period [30 days] and it should not go on your record.

    I do not see that you can be defaulted or have your credit record damaged over £100/letter fees, however.
