Hi thanks for reading..I am 28 and have been employed by my current employer for over 5 years I work on a part time and relief basis my annual salary is just over 6k.
On thursday 15th July I received a call telling me from the end of September I along with my collegues will be made redudndant / unemployed due to lack of funding from the council, the head office still has 5 offices open so they haven't gone bankrupt.
I am 25 weeks pregnant and was due to start my maternity leave mid October.
I phoned head office and the lady was nice enough but was stumped when I asked her questions,I was wondering if any of you kind people could help me out ?
1) What am I entitled to ? smp or ma ? (I am allowed to start my mat leave mid Sept) would this make a difference ?
2) What happens to holiday pay ? I have 13 days owed to me ? shall I try and take them now ? Another person in my office has taken some but the boss of the office doesnt seem pleased.
3) What is the legal notice requirement they have to give me ? I have had no written infomation as yet from them.so much conflicting infomation on the web.
4) What is pay in lieu ?
5) I reckon I should get 5 weeks pay redudndancy (over 22 yrs old and over 5 years service) ..does this take long to come through ?
6) Am I entitled to any other benefit ? my husband earns 21k annaully before tax ? applying for the £190 today when I see my midwife.
sorry to go on I have two children already and am very worried..have a feeling Im going to find it hard to gain employment with 3 young children and want to get things in place as head office are all sitting pretty and quiet, kept their jobs they seem in no rush to answer any questions.
p.s. thanks from me and a rather large bump !
I have been through my contract but nothing on redundancy !

Ignore me, the first 5 points they should know so keep asking them, the benefits question try www.entitledto.comThe Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!
If I give you advice it is only a view and always always take professional advice before acting!!!

1) What am I entitled to ? smp or ma ? (I am allowed to start my mat leave mid Sept) would this make a difference ?
As you are now in the qualifying week (15th week before the expected week of childbirth), you are entitled to SMP.
If, because you are to be made redundant at the end of September, you wish to change the date that your maternity leave starts from October to the end of September; you could do so once you have received written notification of your redundancy date.
2) What happens to holiday pay ? I have 13 days owed to me ? shall I try and take them now ? Another person in my office has taken some but the boss of the office doesnt seem pleased.
Whether or not you take your accrued holiday before your redundancy depends on whether it is convenient for both you and your employer for you to do so. Normal rules within your workplace for requesting leave apply.
If you have any accrued but untaken holiday entitlement when you are made redundant your employer must pay you for them.
3) What is the legal notice requirement they have to give me ? I have had no written infomation as yet from them.so much conflicting infomation on the web.
The statutory notice is one week for each completed year of service.
Check your contract of employment though because it may entitle you to a longer notice period.
A phone call does not qualify as proper notice. You should be informed about your notice period in writing.
4) What is pay in lieu ?
This is when instead of requiring you to work your 5 weeks notice and pay you as they normally would during that time, they pay you 5 weeks pay up front and you don't have to work your 5 weeks notice.
5) I reckon I should get 5 weeks pay redudndancy (over 22 yrs old and over 5 years service) ..does this take long to come through ?
It depends on how you are normally paid and how efficient your payroll department is.
If you are paid monthly you would expect to receive...
All of your earned wages
Pay for any accrued but untaken holiday entitlement
Paid notice
Redundancy pay
(and possibly SMP depending on whether you bring it forward)
... in or before the October pay run.0 -
