Letting agency, landlord and noisy neighbours.

  • This is more posts than I expected!

    The house is in England and the neighbours on the other side are friends with the people next door so I doubt getting any support from them.

    The police were involved because my mum phoned the landlord as there was loud music playing, the landlord phoned the bloke next door who then went storming round to my mum and dads house and threatened my mum and called her every name under the sun, told her "not to phone the landlord ever again". At the time she had hold of my 9 month old neice. He has also threatened staff in the letting agents (yet they renewed his contract!!)

    The block next door is also a liar, he tells the landlord my mum and dad have parties and keep his daughter up until 3am etc.

    They are in breach of their contract and the landlord/agency should be doing something about this but they're do nothing and are really unhelpful which is making things worse.

    He is just really selfish to be honest. But his girlfriend is pregnant so when she has the baby maybe it's time to reciprocate!!

    They need to record evidence of him being agressive if he does it again.

    CCTV or some way of recording sound would help.

    Just to answer this bit - yes they are probably technically in breach of their contract but there is very little the LL can do. LL's can not determine tenancies (this is forbidden by law). Only courts can do this and the reality is that a court will not end a tenancy on issues like this without clear evidence and direction from public bodies such as EH. This is to protect Ts rights under the tenancy.

    If there is something specific that you think the LL should do then by all means propose it but unfortunately there is nothing LL's can generally do about antisocial behavior during a tenancy beyond not renewing the tenancy. Even this action may well require the LL to go to court.

    While I understand your frustrations there really is not alot the LL could do and hence why they are not keen to get involved. You need to keep going with the EH route.

    And if your parents do continue to hound the LL or LA or indeed the tenants then they can be cautioned for harassment. If the police were called for aggressive behaviour then this will all be recorded and you can also present this to the EH. How do you know he threatened the LA? So he might be friends with the guy on the other side but what about those over the road?
