Problem after Bankruptcy

Hi all,

Need some help with the following:

In 2008 i filed for bankruptcy due to me being made redundant after 15 years of service, all my credit cards debts was cleared.

When i filed for bankruptcy i also had a Littlewoods & Next catologue both with a zero balance and the person dealing with my case said i dont need to worry about them as i dont owe them anything so i left it at that.

In 2009 i finally got a new job and everything was going great, The job i had felt very secure (How silly i was to think this).

In the middle of 2009 i decided to order goods from Littlewoods & Next coming to a total of around £4,000 of which i could easy sustain with the pay from my new job.

Just recently i got made redundant again:( and now i am very worried what Littlewoods and Next are going to do to me as i have just received my first warning for no payment.

I am trying like mad to get a job but it is very hard at the moment where i live, i know i should of not purchased anything from Littlewoods or Next as i should of learnt from my first experiance with being made redundant.

What do you think the outcome will be and what can they do to me.

    First of all don't panic, worse things have happened than using catalogues when you shouldn't have...

    Technically even if there was no balance on the catalogues at the time - I think because there were credit facilities they should have gone into the Bankruptcy. But as you mentioned your Examiner said "don't bother"

    So what will happen?

    Nothing awful - if you can't pay the agreed amounts - you'll usually come to an arrangement with the creditors and pay what you can afford (ask them to stop charging you interest).

    You might end up with CCJ's and again you'll pay back a figure you can afford.

    If and it's unlikely - that Littlewoods and Next create a fuss - and tell your OR - that you built up credit over £500 during your B/R - (I'm assuming you did it when you were still Bankrupt).

    Well yes it's an "offence" - but not the crime of the century.

    I'm no expert but I guess the worst that can happen is you might get a BRU.

    You'll still be discharged from Bankruptcy - but the conditions of Bankruptcy will last for a few years.

    When these things happen - and if the creditors do start to create -

    You just tell the truth, say your sorry, indicate that you did have every intention of paying, but circumstances out of your control made it impossible.

    The truth will always set you free - and always makes you feel better.

    They are debts incurred after BR so you are fully liable for them.

    You will just have to deal with them in the same manner as before your BR and come to an arrangement to pay. Give them both a call and tell them you have lost your job and you are unable to sustain the repayments as they are currently (even mimimum payments???) and ask for their help.

    Does this still apply if i ordered the items after 27th November 2009 bankruptcy as per the following letter from my OR:

    Dear ** ********


    I filed the notice of early discharge at the High Court on 27th November 2009, meaning you were discharged from bankruptcy on the same day. This means that you are no longer bankrupt. I posted a sealed copy of the notice to your home address last week.

    Forgot to ask, can Baliffs get involved in anyway? That would be the last thing i would want due to my health issues that happened to me from being made redundant the first time:(

    In that case don't worry at all!

    You didn't borrow money when you were bankrupt.

    So you did NOT commit any offence.

    The debts with Next and Littlewoods are new debts.

    And you'll just come to an arrangement to pay them what you can afford.

    You might end up with CCJ'S - again you'll pay what you can afford.

    The CCJ'S won't have a detrimental effect - because your credit rating is affected for 6 years because of your Bankruptcy.

    So your rating will be affected for a bit longer.

    Bailiffs can only arrive - if you have a CCJ ('s) and don't cooperate with the courts

    So if you get a CCJ fill in the forms and make an affordable offer of repayment.

    If that payment becomes difficult you can apply to have it lowered.

    You can get help with this from the CAB.

    Just so you don't worry - even if Bailiffs did arrive - they have no right of access - just don't let them in.

    It is possible that a Debt Collection person could arrive - again do not be concerned - they have no right of access and you have no obligation to let them into your home.

    In other words don't worry.

    I am dreading phoning them as i cannot see them being very happy due to me being on Jobseekers Allowance, I mean how much can they take from me as i only get £64.00 a week to live on until i get a job which may take somewhile judging from my previous experiance:(

    I think that this is the best course of action

    Its good you have identified that you should not have purchased the items. Rule of thumb for me is to _never_ buy "want" items if I haven't already got the money in the account. Death and taxes....
