Car dealer not honouring warranty

Hi,

I bought a car just under 2 months ago, and at the time it had an engine management light on. They got it checked out and replaced a sensor of some sort. They then said that the light is still on but they dont know why, and that they have had it checked at a "specialist" and they dont know why the light is still on either, and that there were no fault codes on the ECU.
So I still went ahead with the purchase (probably wrongly with hindsight, but went with my heart not my head!)

anyway, the other day another, different, light appeared on the dash, and the car seemed to lose power for a few seconds. Took it in to the local branch this particular dealer has (as bought it about 30 miles away) and they originally said it needs a new sensor, can they hang on to my car an extra day while they wait for it to be delivered. Then when i pick car up next day they say all they did was change the oil and filter (at audi's recommendation) and that cured it. took car home and light on dash came back on the next day. took it to audi for diagnostic (paid by warranty) and audi say it needs over £2400 of work to fix!

now the dealer I bought the car from say that because the engine light was on at time of purchase that it's not covered by the warranty. but i was told there were no fault codes registered, and that the "specialist" did not know why the light was on. now i'm thinking they did actually know, but didn't want to fork out 2 grand to sort it!

so basically wondering where i stand on being able to claim for this job on the warranty. only have 1 month left on it so would like to get it sorted soon!

cheers.

How old is the car? If it was a banger I think you might struggle a bit.

This bit would also worry me a bit:-

    Age of car?

Was it bought from an Audi dealership or independent? Is the warranty the manufacturer one (ie. less than 3 years old I think for Audi's) or the dealers own?

If the manufacturer's then as long as all the required services have been carried out properly at an authorised dealer, and it's not 'wear and tear' then you should be covered.

If the dealer's own warranty then check the T&C's to see what it covers or not. Within the first six months the fault is considered to have been there at the time of purchase so you have some comeback. However, how much depends on the age and condition of the car and what you paid for it. An old banger can't reasonably be expected to be 100% trouble free, whereas a 3 year old car you paid retail price for would generally be.

It also complicates matters that you knew of a fault at the time of purchase, although on the other hand the seller assured you it was only cosmetic (warning light) and not mechanical. Is any of this available in writing, fault report etc?

Frankly if you're stupid enough to buy and drive away a car with an engine warning light on then I'm sorry but you only have yourself to blame.

    Absolute lunacy.
  • doesnt matter that the engine light was on, i wasn't told about the full extent of the car's faults. i've now got a refund under the sale of goods act.
