Goldtrail

Hi apologies if i'm in the wrong forum here but its my first time on the forum.
I have a question concerning the goldtrail company that went bust at the weekend, I know I can claim the money back through ATOL, but I thought as I had paid for the holiday using my credit card that I would try and claim it back through Barclaycard as it may be quicker.
After speaking to a not so friendly Barclaycard CS person today I am slightly confused and could do with some advice please.
I booked the holiday through an agent and paid the agent the full amount at the time of booking, the agent informed me that the holiday package was with Goldtrail, Barclaycard told me today that as I had booked the holiday through an agent I was not out of breach of contract and therefore could not claim the money back through them under section 75, he also said that as goldtrail only booked the flights my room in the apartments was still available therefore I would not be able to claim any money back for this either.
Is Barclaycard correct in what they have said, and am I right in thinking that the only way ever to be able to claim money back in this way from a credit card company is to make sure you book your holiday with a company who have there own planes, and there own apartments etc. Thanks.

    Barclaycard are right you need to claim from ATOL.

    If you had booked directly with Goldtrail then you could claim using section 75. But as you booked through an agent you cannot as the agent is still solvent and not in breech of contract.

    The money will come from ATOL, may take some time but you'll get it.
  • Hi, this section 75 can be confusing, surely rob45 paid the full amount to the travel agent for a service that they are now not going to supply, so i don't understand why he cant claim against the credit card? We are also in a similar position having booked a holiday with mediatravel paying everything in one lump sum and they arranged the flights with Goldtrail. Talk about getting kicked from pillar to post.

    Dave you must fill in the CAA form, if you want new flights you must pay for new ones in full

    Correct, if you pay through an agent you must claim from the CAA ATOL scheme.

    If you were to attempt charge back under credit card section 75, the agent could lose the money and would not themselves be able to claim back from the CAA which is morally wrong.

    The credit card company should recognize this, and if they do not and go ahead and refund you , they will take it back again at a later date and refer you to the CAA and all you will have done is delay the claims process.

    The most important question is whether you have a copy of the invoice issued by Goldtrail for your flights, if you do, there is no problem and you will get your money back. If you didn't, and there seems to be a lot of agents who never passed on the documrntation, then you may have to make a claim from the agent as the CAA will consider that there is no contract between you and the failed company

    Also look on that inovice to see that you have been charged APC at £2.50 per passenger and that the inovice from Goldtrail which you should have from your agent if they are honestly only an agent.....as some travel agents were trading on an ATOL to ATOL basis with Goldtrail.

    That effectively means that if you do not have the charge on your invoice, you are not going to get your money from CAA as you have not paid your APC, or to make it easy, your insurance.

    If thats the case, hammer on the door of your agent as they will be responsible for the refunds.
