the oven cleaner man story

So I've been in my new house almost 4 weeks and I love it :D

The kitchen has a built in oven/hob which I have not used due to the previous tenant leaving it absolutely manky.

Last week the landlady organised for a oven cleaner man to clean and that he did. In the process, he removed the door and it wouldnt go back on.

So, he then sent an oven repair man round (I kid thee not) and he has just left. The hinges that hold the door are completely kaput and he has told me a whole new oven needs to go due to the makers going bust. You can't get spares (its an Arrow oven).

So my question is - who is responsible for a new oven? The oven cleaner man or the landlady?

thanks x

and if she thinks it is carelessness caused by the cleaning company, she can take it up with them.

The oven cleaner man is responsible for her cooker. He is definitely responsible for replacing it.

Her cooker is rented to you.

    Mmm. Complicated.

Surely Landlady is responsible to you to ensure you have working oven...
but maybe landlady has right to raise issues with Oven Repair man.

Doesnt sound like accidental damage, more wear & tear.

 Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

  • its a B&Q one apparently

Yes the landlady is insured so I let them battle it out x
  • The important question to ask in this situation is: Am I responsible?

If answer = NO, then it is the LL who has a problem, and a responsibility, how he/she deals with it is down the him/her.
Unless it is damaged or discontinued - ignore any discount of over 25%

As I see it, it's LL's issue to deal with. You say that the LL arranged for the oven cleaning man. Therefore, the contractual relationship is between the LL and the oven cleaner.

You have a contractual relationship with the LL but you have no contractual relationship with the oven cleaner.

All this assumes that you simply informed the LL of the dirty oven and SHE dealt with that issue, choosing, organising and paying the oven cleaner.
