The clue is this bit Chinese selller. What did you expect?
If you have claimed they were fakes in your claim you need to prove this. You need to get written confirmation from a manufacturer /supplier or retailer that they are fake if not you will lose. If you do this and win you wont have to return them and will get refunded
If you just claimed they were not as described you will be told to return them (at your cost tracked) for a refund0 - 
            so if the seller does not respond within 10 days will paypal award in my favour ??
As for authenticity the seller has many duplicate accounts selling the same lacoste shirts and when I reported them to ebay all the ones reported were remove the same day.
Obviously ebay tollerate these fakes because they are making ebay/paypal money.0 -

Ebay pulled them when advised though?
Realistically while people still fall for buying fakes (and it was fairly obvious they were going to be) these scammers will continue to sell.             When you open and escalate the claim YOU get 10 days to PROVE it is fake. This must be on official authorised letterhead from an approved Agent/Supplier or the company themselves.0
