Car Deposit Demand - Advice Please

Hello

In September last year we ordered a Fiat 500, initially we were going for the scrapage scheme with our old car but then apparently it didn't qualify as it was manufactured in Ireland. Anyhow we then agreed with the garage to give them our old car and £1000 as the deposit and finance the remainder. We finally we took delivery of our new car just before Xmas 09.

My wife and kids like it and are happy pottering around and about in it. Last week (7 months after delivery) the garage ring to say it would appear that they never took our £1000 and that they would like it within the next couple of days. We have checked our bank statements and I can confirm they have not taken the money, the garage lady said it was a mistake on her behalf.

It was never our intention to avoid giving the deposit and with going back and forth to the garage over the 3 months, from initial order to delivery, we just assumed they had taken the money. At some point from either myself or my wife as we provided all the forms of ID they required.

Unfortunately now, times are tough and we don't have that kind of money at hand. We are on a scheme with CCCS so every penny is accounted for. We still pay the monthly payments on the car and I just wondered where we stood with giving the garage the money they want?

Any advise / assistance greatly appreciated

    Sell the car, pay off the debts including the £1,000 to the garage and buy a cheap run around for the Mrs. You can still get a good, safe & economical car for about £3k.

    You owe the money but if I were you I would ask them for a discount since it was their error.

    You say every penny is accounted for now but it obviously wasn't then. I'd certainly notice if my bank account was £1000 better off than it should be:think:.

    Unfortunately for you I think you'll have to pay it although if it was me I'd insist on more time to pay.

    Pay up. Sorry but your clearly at it. How on earth could you struggle to pay every penny, be on CCCS etc but not notice an extra 1k in the bank. Answer you couldn't. You thought you had got away with it and spent the money.

    Furthermore someone who is skint shouldnt be financing 7k. Exactly what is wrong with this country.

    I think that post is enough to close the thread, couldn't be better out.

    If you are struggling financially you do not go around buying new cars.

    Well up until my "Eureka moment" a few months ago, most things were going on the evil credit cards and like a lot of people I was ignoring my debts / statements. So as a result the deposit was planned to go on the credit card (if they took it).

    When I signed up for the CCCS I declared all my creditors (So I thought) and CCCS worked out my budget for paying them back in only 6 years now. As I never checked my CC statement I didn't know any different and carried on living the dream on the easily available credit card.

    Now the credit cards are gone my bank account is basic and I'm a cash / debit card only person, the CCCS have been very helpful and the weight off the shoulders is great. I appreciate that i was very stupid regarding my debt, but I'm trying to overcome that issue now and I had to start somewhere.

    Regarding the debt, I will speak to the CCCS.

    Yeah of course you did.
    Your story about not noticing you had an extra £1000 is frankly laughable because your the sort of person who would have spent it on something else.

    Happen to have had a new TV or holiday around the time of buying the car ;)

    Although you will need to pay this back, you could ask to pay in installments - say £100 a month, as it is their fault.
