Goldtrail and where I stand with my credit card

We booked our summer holiday with Goldtrail and are now seeking a refund.
We can claim this back through the CAA but it can take up to a year. The credit card company are saying that we have to go through the CAA rather than obtain a refund with them.

I'm currently looking into section 75 of the consumer credit agreement to understand if the credit card company are just trying to fob us off and pass the buck.

The credit card balance for the holiday was due to be paid off this month. Are we still obliged to pay this off even though we haven't and won't receive our goods?

As we've now got to fund another holiday whilst we await our refund it would be helpful if there was a freeze on the outstanding Goldtrail balance and any interest?

Can anyone help?

    Do not pay the balance. You'll probably have to wait for the CAA to pay up for the deposit.
  • We didn't pay a deposit - we booked about 2/3 weeks ago so had to pay the price in full which went on my credit card. We split paying that off over 60 days so were going to pay off the rest this month.

    If I don't pay the remaining balance am I still liable for the interest on it?

    You must claim through the CAA it wont take upto a year, the CAA have said it will not be anywhere as manic as the collapse of XL

    Hi Del,

    Sorry to hijack but this may be relevant to others too. We booked with Hays who said we should fill in our personal details on the ATOL form and send it to them and they will do the rest on our behalf (produce invoices, fill in the rest and send it to CAA for us). My question is can they charge us (ie keep a proportion of the refund!) for doing this???

    Sorry I misread your post. You need to speak to your credit card provider to see whether it will charge interest on the amount. If they are making you wait for the CAA and not refunding they ought not to charge morally, but you cannot take that for granted.

    If you booked directly with Goldtrail and payed by credit card you can claim via your credit card under the consumer credit act. The following quote is taken from the CAA Q&A link below:

    Q What if I paid by credit card?
    A [FONT=Arial,Arial][FONT=Arial,Arial]If you booked through a travel agent and paid by credit card you should claim from the CAA. Speak to your travel agent about making your claim.
    If you paid direct to GT, you should contact your credit card issuer about a refund under the Consumer Credit Act.

    This has been the same with previous failures, but is only if you booked and payed directly with Goldtrail on a credit card. If you booked via a travel agent then you should pursue an ATOL claim.

    As apt has stated contact your credit card company before simply not paying it. You should be able to dispute the transaction, and hopefully they will not charge interest on that balance while it is in dispute. Tell them that the CAA have instructed you to claim from them under the consumer credit act. Note, as above, this only applies if you payed direct to Goldtrail.
