ESA WAITING FOR TRIBUNAL DECISION. and have found A JOB.Query on back to work credits

Hi,

Can anyone give me some advice please, I am waiting to hear from the tribunal after failing my ESA assessment, however, i the meantime I have possibly found a part time job (20 hrs)which accomodates my illness, I have depression and social phobia but a friend has found me a job working with her which would at least get me back into paid work and she would be there to support me. Anyway would I be able to still get the £40 back to work credit if the job comes up even though I am still awaiting a decision from tribunal.

Any advice would be most helpful

    I believe if the job is over 16 hours or over £93 per week, then you should qualify for Return to Work credit. There should be something on one of the DWP's own sites that gives more info about that, and eligibility for it.

    The downside of that is that RTW takes weeks to process (when I claimed it, it was over 8 weeks in before I started receiving it!).

    Why shouldn't it qualify? Have you been given a date for the tribunal hearing?

    In the meantime, if you contest the decision, it would be worth getting any doctors/specialist letters to hand, especially ones where the GP is writing to a specialist he referred you to. If the letter specifically refers to 'inability to do work', then that is excellent evidence in itself - you have it in writing that another doctor (who will know you much better than the Atos pencil-pusher) expresses an opinion contrary to the Atos report.

    Also, check the Atos report, and list any contradictions you see there. Then, these are reasons you can use to contest the report and make a case for why the Atos report can be discredited as evidence.

    Just wasnt sure if I would qualify as DWP obviously think I am capable of working, As I said in my post, hopefully I have found something which I can deal with, with regards to getting back to work. To be honest I am fed up with the whole ordeal, suffering from depression and anxiety this whole process has, to be honest, made me feel even worse. Just hope I get this job and can leave all of this behind me.

    The DWP's opinion is their opinion - it isn't factual or final.

    The tribunal is your chance to argue your case and prove them wrong.

    I went through the depression/anxiety phase myself, and know where you're coming from.

    However, I've never been one to tolerate liars and will make it difficult for them - whether they're people, companies or government departments.

    It's a hang-up of mine.
