Ticket for Parking at a shopping centre

Hi I need some advice after reading posts from here I decided to appeal against a parking eye ticket this is the reply I received below any advice will be helpful

Good evening,
Thank you for your correspondence in relation to the outstanding Parking Charge incurred on 20/06/2010 at the shopping centre address.

We are writing to advise you that your recent appeal has been unsuccessful at this time, and further evidence is required if you wish us to consider your appeal further.
You have stated that you were not the driver of the vehicle at the date and time of the breach of the terms and conditions of the car park, however you have failed to inform us who was, so the outstanding parking charge remains your responsibility.
Judge Ackroyd, 2008, Oldham Court, Combined Parking Solutions versus Mr Stephen Thomas, in the case where Mr Thomas claimed not to be the driver, but did not state who was, ruled that on the balance of probability he was the driver and ordered the Charge to be paid plus additional court costs. Therefore your options are either:
* Pay the outstanding Parking Charge, or
* Inform us who was the driver so that we can pass the responsibility of the Parking Charge onto them
If you choose to provide further evidence relating to your appeal within the next 7 days, we will place the outstanding charge on hold for a further 14 days whilst we consider your appeal further.
Otherwise please call our offices on 0844 247 1189 to arrange payment of this Parking Charge.

    I can't believe you were advised to appeal, I have never known PE to uphold any appeal, so it's a complete waste of time.

    The good news is that PE, regardless of what they try to imply in their letter, have never issued a court claim against anyone.

    From now on, no more contact, just ignore everything. The last letter I had threatening possible litigation was last November, haven't heard a word since.

    Why one earth did you decide to appeal a fake ticket 'after reading posts here'?

    We clearly say to ignore these scam tickets. We tell everyone that ALL appeals are declined because that's part of the con, they pretend to have an appeals process so people believe they are legitimate in issuing fines. They cannot issue fines!

    Do you mean you read Martin's article and decided to appeal? The article is old and the regulars on here disagree with that old advice to write and say you weren't the driver. Whatever your situation, there's never any point contacting a PPC over a parking charge notice.

    Just ignore the rubbishy ticket and the debt collector letters they'll send to the registered keeper.

    DO NOT even think about paying it. You have been had if you believe this scam.

    If you'd searched first you would have found loads of threads on this forum about private parking tickets, and plenty about ignoring Parking Eye.

    See all the advice given on this similar thread. Look at both pages of advice and all links given by myself and by other posters. Make sure you watch the youtube clip of Watchdog's legal bod's advice on what to do with your ticket. Read it all on that thread, until you realise it's just a con and you are safe to bin that ticket:

    For the benefit of any newbies who might be scared by this, I'd just like to point out that some people believe the Stephen Thomas case was a set up by our old friend Perky.

    Anyone who lies to a Judge is going to lose, setup or not. (I do agree it was probably a setup though.)
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
  • thanks to all I will certainly ignore any mails from now on just to clarify the letter was sent by email after I appealed by post they never replied so i decided to send an email then i got the reply posted above

    there was no need to reply now i can see that from now on is ignore all letters from parking eye.
  • My other half has recently received a 'Parking Charge Notice' as the registered keeper from a company called New Generation Parking. She wasn't the driver of the car at the time and was some 15 miles away at a business meeting. Naturally there are a lot of witnesses and evidence to this fact. She is intending to ignore all the letters and demands as advised here, but she is pretty nervous about the possibility of court, regardless of how unlikely this is and how strong her defence would be. Is it worth telling the company at an early stage that she can prove beyond all reasonable doubt that she was not the driver and to stop sending her letters or will this not make any difference?

    No, it'll be a nice surprise in your defence, should they ever be stupid enough to make a court claim
    and to stop sending her letters or will this not make any difference?

    Judge Ackroyd is a District Judge at Oldham County Court whose decision is binding and threatening to.........noone!!!!!!!!! I have tried to look up this decision but cant find it anywhere. Do not give this any credence
