Council avoiding responsibility for Subsidence caused by their tree - please help

    You are somewhat lucky to get a settlement agreement so soon. My neighbour had to have the cracks in his house measured twice a year for 5 years before the two insurance companies agreed a settlement over an enormous London plane tree causing damage.

    ""through the small claims court"" - even if you do this after your insurers have got a settlement the council lawyers will no doubt get it moved up to a higher court where you risk having to pay their fees if you lose....

    I do find it laughable that people can 'own' things like that.

    You aren't privvy to the dealings done in these situations. To be fair it isn't really the councils fault is it? They'd stuck some trees up to make the place look nice, rather than some motivated attack on your property, they haven't ran a garbage truck into your extension. So without admitting liability they've offered 70%, you don't say how much the damage is. Your insurer might get more if they got their heavy lawyers in, but the council would argue that its not all their fault. The insurer is probably happy with this as the most cost effective option for them.

    OK, thanks for all responses - not what i was hoping for but i came on here asking for independant views and thats what i received, might help put it into context, thanks to all who replied. :beer:
